Arcadia City Council Chambers PLEDGE OF ALLEGIANCE ROLL CALL SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON - PUBLIC HEARING ITEMS — 5 minute lime limit per person. PUBLIC HEARINGS All interested persons are invited to appear at a Public Hearing and to provide evidence or testimony concerning any of the proposed items set forth below for consideration. You are hereby advised that should you desire to legally challenge any action taken by the Planning Commission with respect to the proposed item for consideration, you may be limited to raising only those issues and objections, which you or someone else raises at or prior to the time of the Public Hearing. 1. MODIFICATION APPLICATION NO. MP 12 -02, SINGLE- FAMILY ARCHITECTURAL DESIGN REVIEW NO. SF ADR 11 -110 AND OAK TREE ENCROACHMENT PERMIT NO. THE 11-36 1560 Hyland Avenue Jeremy Taylor (designer on behalf of property owners, Cynthia and Evan Pan) Continued from April 24, 2012 The applicants are requesting the following Modifications, Architectural Design Review, and Oak Tree Encroachments to add to and rebuild an existing 2,075 square -foot, one -story, single - family residence for a 2,785 square -foot, one -story residence with a 691 square -foot, attached, two -car garage, and two, attached, covered decks with a total area of 465 square feet, and a 600 square - foot, detached recreation room: A. A 37' -1" front (northerly) yard setback in lieu of the 39' -0" average of the two nearest front yards (1616 & 1620 Hyland Ave.) for a 330 square -foot bedroom with study area addition. B. A 7' -91/4" rear (southerly) yard setback in lieu of 25' -0" for a 652 square -foot, attached, two -car garage, a 102 square -foot home office, and a 318 square -foot covered deck. C. A 17'- 103/4" rear (southerly) yard setback in lieu of 25' -0" to retain a portion of the existing family room, and an approximately 19' -0" rear yard setback in lieu of 25' -0" to retain a portion of the existing study and living room. RECOMMENDATION: Approval of Modification Application No. MP 12 -02, and Single -Family Architectural Design Review No. SF ADR 11 -110; and conditional approval of Oak Tree Encroachment Permit No. THE 11 -36 There is a five (5) working day appeal period after the approval/denial of the applications. Appeals are to be filed by 5:30 p.m. on Wednesday, May 30, 2012. 2. TENTATIVE PARCEL MAP NO. TPM 12 -01 (Parcel Map No. 71953) 818 S. Golden West Avenue Shine Development (Property Owner) The applicant is requesting a Tentative Parcel Map for a four -unit residential condominium subdivision. RECOMMENDATION: Approve There is a ten (10) day appeal period after the approvalkienial of the subdivision. Appeals are to be filed by 5:30 p.m. on Monday, June 4, 2012. 3. CONDITIONAL USE PERMIT NO. CUP 12 -04 159 & 161 E. Foothill Boulevard Terence Kwok The applicant is requesting a Conditional Use Permit for a martial arts studio with a maximum of 40 students in a 3,200 square -foot commercial space at an existing neighborhood shopping center. RECOMMENDATION: Conditionally approve A Resolution reflecting the decision of the Planning Commisison will be presented for adoption at the next Commission meeting. There will be a five working day appeal period after the adoption of the Resolution. 4. CONDITIONAL USE PERMIT NO. CUP 12 -05 2634 E. Duarte Road Pastor Bob Alvarez The applicant is requesting a Conditional Use Permit for a martial arts studio with a maximum of 25 students in a 1,200 square -foot space at an existing commercial center. RECOMMENDATION: Conditionally approve A Resolution reflecting the decision of the Planning Commisison will be presented for adoption at the next Commission meeting. There will be a five working day appeal period after the adoption of the Resolution. First Avenue Vincent -Marco Duchetta The applicant is requesting a Conditional Use Permit for a martial arts studio with a maximum of 20 students in a 2,714 square -foot commercial space at an existing mixed -use commercial- residential center. RECOMMENDATION: Conditionally approve A Resolution reflecting the decision of the Planning Commisison will be presented for adoption at the next Commission meeting. There will be a five working day appeal period after the adoption of the Resolution. 6. HOMEOWNERS ASSOCIATION DECISION APPEAL NO. HOA 12 -01, MODIFICATION APPLICATION NO. MA 12 -22 AND OAK TREE ENCROACHMENT PERMIT APPLICATION NO. THE 12 -15 1101 San Carlos Road Robert Tong The applicant is appealing the Santa Anita Oaks Homeowners' Association's Architectural Design Review Board decision to deny the architectural design of a proposed 7,833 square-foot, two -story, single - family residence with a 956 square -foot, attached, three -car garage with workshop. The proposal also requires a Zoning Modification to allow a 29' -7" street side yard setback in lieu of a 50' -0" special setback from Foothill Blvd. (AMC Sec. 9320.30.2) and an Oak Tree Encroachment Permit for new Landscaping and perimeter fences/walls to encroach upon two (2) oak trees (AMC Sec. 9703). RECOMMENDATION: Conditionally approve appeal, Modification and Oak Tree Encroachment Permit There is a five (5) working day appeal period after the approval/denial of the appeal and applications. Appeals are to be filed by 5:30 p.m. on Wednesday, May 30, 2012. 7. TEXT AMENDMENT NO. TA 12 -01 Citywide The Development Services Department is initiating the following Text Amendments to the Commercial Industrial Zones and Conditional Uses of the Zoning Ordinance (Parts 6 and 7 of Chapter 2 of Article IX) of the Arcadia Municipal Code: 1. Add personal service businesses by Conditional Use Permit (CUP) at properties zoned CPD -1, CBD, and DMU. (Personal service businesses are already allowed by CUP at properties zoned C-1, C -2, C -M and MU.) 2. Provide for and clarify that tutoring centers are allowed by Conditional Use Permit at properties zoned CPD-1 and CBD, and that tutoring centers are already allowed by CUP at properties zoned C-1, C -2, C -M, and MU. 3. Restrict Bars and Cocktail Lounges to being allowed by Conditional Use Permit at properties zoned C-2 and C -M. Provide clarification that the sale of alcoholic beverages for off -site consumption is subject to a Conditional Use Permit. 5. Prohibit bail bond businesses and check cashing businesses. 6. Provide that pawn shops and thrift stores are to be allowed by Conditional Use Permit at properties zoned C -1, C -2, CBD, C -M, DMU, and MU. RECOMMENDATION: Recommend approval to City Council The Planning Commission's recommendation and comments will be forwarded to the City Council. 8. TEXT AMENDMENT NO. TA 12 -02 Citywide The Development Services Department is initiating Text Amendments to the Single - Family Residential Zoning Regulations (Divisions 0, 1 and 2 of Part 5 of Chapter 2 of Article IX) of the Arcadia Municipal Code to amend the parking and storage regulations for motor vehicles, including recreational vehicles, trucks, commercial vehicles, motorcycles, motorbikes, buses, motorhomes, trailers, boats and housecars. RECOMMENDATION: Recommend approval to City Council The Planning Commission's recommendation and comments will be forwarded to the City Council. 9. CALIFORNIA ENVIRONMENTAL QUALITY ACT GUIDELINES A report and resolution of the City of Arcadia amending and adopting local guidelines for implementing the Califomia Environmental Quality Act (CEQA) (Public Resources Code Sections 21000 et seq.). RECOMMENDATION: Recommend approval to City Council CONSENT ITEMS 10. MINUTES OF MAY 8, 2012 RECOMMENDATION: Approve MATTERS FROM CITY COUNCIL & PLANNING COMMISSION MODIFICATION COMMITTEE AGENDA MATTERS FROM STAFF & UPCOMING AGENDA ITEMS ADJOURNMENT Any writings or documents provided to a majority of the Planning Commission members regarding any item on this agenda will be made available for public inspection in the Community Development Division offices at City Hall, 240 W. The public hearing item is introduced by the Chairman of the Planning Commission. 2. The staff report is presented by staff. 3. Commissioners' questions relating to the staff report may be asked and answered at this time. 4. The Public Hearing is opened by the Chairman and the applicant is afforded the first opportunity to address the Commission. 5. Others in favor of the proposal are afforded the opportunity to address the Commission. (LIMITED TO 5 MINUTES) 6. Those in opposition to the proposal are afforded the opportunity to address the Commission. (LIMITED TO 5 MINUTES) 7. The applicant may be afforded the opportunity for a brief rebuttal. (LIMITED TO 5 MINUTES) 8. The Commission closes the public hearing. 9. The Commission members may discuss the proposal at this time. 10. The Commission then makes a motion and acts on the proposal to either approve, approve with conditions or modifications, deny, or continue it to a specific date. 11. Following the Commission's action on Conditional Use Permits and Variances, a resolution reflecting the decision of the Planning Commission is prepared for adoption by the Commission. This is usually presented at the next Planning Commission meeting. There is a five (5) working day appeal period after the adoption of the resolution. 12. Following the Commission's action on Modifications and Design Reviews, there is a five (5) working day appeal period. 13. Following the Commission's review of Zone Changes, Text Amendments and General Plan Amendments, the Commission's comments and recommendations are forwarded to the City Council for the Council's consideration at a scheduled public hearing. 14. Following the Commission's action on Tentative Tract Maps and Tentative Parcel Maps (subdivisions) there is a ten (10) calendar day appeal period.
