RESOLUTION NO. 4612
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARCADIA GRANTING A CONDITIONAL USE PERMIT
FOR A RESTAURANT AT 101 WEST HUNTINGTON DRIVE
WHEREAS, the City Council and Planning Commission have conduc-
ted public hearings for the purpose of allowing a restaurant,
Planning Department Case No. C.U.P. 76-26, on the property commonly
known as 101 West Huntington Drive, more particularly described as
follows:
A portion of Lot 1, Tract 949, in the City of
Arcadia, County of Los Angeles, State of
California, as per map recorded in Book 17,
Page 13 of Maps, in the office of the Recorder
of said county.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the staff report is true and correct.
SECTION 2. That the City Council finds that:
1. The residents of the surrounding area testifying
at the continued public hearing February 15, 1977 on the revised
plan for C.U.P. 76-26 testified that they were no longer opposed
to the use of the property as a restaurant, but were opposed to

the requested 24 hour operation.
2. The granting of the conditional use permit as
hereinafter provided, with the conditioJll specified in Section 3
herein, will not be detrimental to the public health or welfare,
or injurious to the property or improvements in such zone or
vicinity.

3. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
4. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
spaces, walls, fences, loading, landscaping, and other features re-
quired to adjust said use with the land and uses in the neighborhood.
5. The site abuts streets and highways adequate in,
width and pavement type to carry the kind of traffic generated by
the proposed use.
6. The granting of such conditional use permit will
not have a significant effect on the environment, and will not ad-
versely affect the comprehensive general plan.
SECTION 3. That, for the foregoing reasons, the City
Council grants a conditional use permit for a restaurant, subject
to compliance with all applicable regulations of the Arcadia Muni-
cipal Code and upon the following conditions:
1. The property shall be improved and maintained in
accordance with the revised plans in the staff report dated
January 25, 1977, on file in the subject case No. C.U.P. 76-26.
2. Dedicate a 25' radius corner cut off at the
northwest corner of Santa Clara Street and Huntington Drive; right
of way to provide for a parkway 8' in width, on Santa Clara Street.
3. Close existing driveway aprons not to be used;
construct sidewalk on Santa Clara Street in accordance with City
standards, including a handicap ramp at the northwest corner of
Santa Clara and Huntington; parkway tree wells and tre~s shall be
required in accordance with plans to be approved by the Director

of Public Works.
NOTE: The work required under this condition may be
done concurrent with construction of the development.
4. Submit grading and drainage plans, and obtain
approval of same from the Director of Public Works.
5. Parking shall comply with code.
6. Egress from the driveway on Huntington Drive
shall be restricted to "right hand turns" only and posted according-
ly.
7. The hours of operation be limited to 6:00 a.m.
to 11:00 p.m. Sunday through Thursday, 6:00 a.m. Friday morning
to 1:00 a.m. Saturday morning, and 6:00 a.m. Saturday morning to
1:00 a.m. Sunday morning. If after a hearing it is determined by
the City Council that the 6:00 a.m. opening time results in an
adverse impact on the adjoining residential areas, the opening hour
may be restricted to 6:30 a.m.
8. That all deliveries be restricted to 7:00 a.m.
through 10:00 p.m.
9. Restroom facilities comply with the Uniform
Plumbing Code.
10. Architectural treatment on the east wall shall
be consistent with the decorative treatment on the south elevation
and such plans shall be submitted to and approval thereof obtained
from the Planning Department.

11. A landscape and irrigation plan shall be
submitted to and approval thereof obtained from the Planning De-
partment prior to installation.
SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the tity Council of the oity of
Arcadia held on 1st day of March, 1977, by the affirmative vote
of at least three Councilmen, to wit:
