A. RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA THAT THE ANNUAL CONFERENCE
OF THE LEAGUE OF CALIFORNIA CITIES MEETING
IN SAN FRANCISCO IN SEPTEMBER, 1977, SUPPORT
THE REPEAL AT THE EARLIEST POSSIBLE DATE OF
THE POLICE OFFICERS' PROCEDURAL BILL OF
RIGHTS, AB 301
WHEREAS, AB 301, known as the "Police Officers Proce-
dural Bill of Rights" passed in the 1976 session of the
California Legislature, severely constrains the ability of
local agencies to make thorough investigation of complaints
against police personnel; and
WHEREAS, AB 301 limits excessively effective discipline
within a police department; and
WHEREAS, AB 301 does not protect the citizen complain-
ant and opens such complainant to the possibility of adverse
publicity and action; and
WHEREAS, AB 301 abolished the polygraph as an effective
lead tool in internal investigations of possible improper per-
formance by police personnel; and
WHEREAS, this law provides special benefits to the one
group of public employees whose integrity must be the highest:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Arcadia that the Annual Conference of the League of
California Cities meeting in San Francisco in September, 1977,
support the repeal of AB 301 at the earliest possible date.
The City Clerk shall certify to the adoption of this
resolution.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the City Council of the City of
Arcadia held on the 5th day of July, 1977, by the affirmative
vote of at least three Council Members, to wit:
