A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA APPROVING A MAP AND
DECLARING INTENTION TO VACATE AND ABANDON
A PORTION OF THE ALLEY LOCATED BETWEEN
SECOND AVENUE AND THIRD AVENUE AND BETWEEN
ALICE STREET AND DUARTE ROAD: DIRECTING
THE CLERK OF THE COUNCIL TO FILE SAID MAP
IN HER OFFICE: DESCRIBING SAID ALLEY POR-
TION AND RIGHT-OF-WAY TO'BE RESERVED AND
EXCEPTED; SETTING A PUBLIC HEARING THEREON
FOR AUGUST 16, 1977; AND DIRECTING NOTICE
HEREOF TO BE POSTED
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY
DETERMINE AND RESOLVE AS FOLLOWS:
SECTION l: This City Council of the City of Arcadia does
hereby approve that certain map entitled, "Proposed Alley Abandon-
ment Map of a portion of the alley located between Second Avenue
and Third Avenue and Between Alice Street and/Duarte Road" as the
map showing aforedescribed alley portion which this Council here-
inafter declares its intention to vacate and abandon subject to
the reservation and exception of a certain easement and right-of-
way hereinafter described.
SECTION 2: The City Clerk is hereby directed to file said
map in her office where the same may be examined by any and all
persons desiring to do so.
SECTION 3: Pursuant to and in accordance with provisions
of Part 3 of Division 9 of the Streets and Highways Code of the
State of California, this Council does hereby declare its intention
to order the vacation and abandonment of, and to vacate and abandon
that portion of the alley located between Second Avenue and Third
Avenue and between Alice Street and Duarte Road, subject to the
easement. and right-of-way hereinafter described which is delineated
on said map, to which reference is hereby made for full and further
particulars.

SECTION 4: Notice is hereby given that at the hour of
7:30 p.m. or as soon thereafter as the matter can be heard, on the
16th day of August, 1977, in the Council Chambers of the Arcadia
City Hall, 240 West Huntington Drive, Arcadia, California, a
public hearing will be held by this Council at which time any and
all persons interested in or objecting to the proposed vacation
and abandonment and the reservation and exception of the easement
and right-of-way hereinafter described may appear and be heard.
SECTION 5: The Clerk of the Council is hereby directed to
cause the Resolution to be published in The Arcadia Tribune within
fifteen (15) days after the date of adoption of this Resolution
and at least ten (10) days before the date set for said hearing.
SECTION 6: The Director of Public Works is hereby directed
to cause notices of said proposed street vacation and abandonment
to be posted conspicuously along the line of the portion of the
alley hereinafter described, which is proposed to be vacated and
abandoned at least ten (lO) days before the date set for said
hearing. Such notices shall be posted not more than three hundred
feet (300') apart, but at least three (3) shall be posted. Such
notices shall state the passage of this Resolution of Intention
and the time and place of the hearing.
SECTION 7: Said section of said portion of the alley pro-
posed to be vacated is more fully described as follows:
That portion of the alley in Block 61-1/2 of a
part of the Arcadia Santa Anita Tract as shown
on Map recorded in Book 16, Page 58 of Miscellane-
ous Records in the Office of the Recorder of Los
Angeles County lying westerly of the northerly
prolongation of the easterly line of Lot 6 in
said Block.

Reserving and excepting to the City of Arcadia the per-
manent easement and right at any time, or from time to
time, to construct, maintain, operate, replace, remove,
and renew sanitary sewers and storm drains and appurtenant
structures in, upon, over and across any street or part
thereof proposed to be vacated and pursuant to any exist-
ing franchises or renewals thereof, or otherwise, to con-
struct, maintain, operate, replace, remove, renew, and
enlarge lines of pipe, conduits, cables, wires, poles,
and other convenient structures, equipment and fixtures
for the operation of gas pipe lines, telegraphic and
telephone lines, railroad lines, and for the transporta-
tion or distribution of electric energy, petroleum and its
products, ammonia, water, and incidental purposes, including
access and the right to keep the property free from inflamm-
able materials, and wood growth, and otherwise protect the
same from all hazards in, upon and over the street or part
thereof proposed to be vacated.
SECTION 8: The City Clerk shall certify to the adoption of
this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 19th day of July, 1977, by the affirmative vote of at
least three Council members, to wit:
