HomeMy WebLinkAbout4763 o RESOLUTION NO. 4763 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA APPROVING TENTATIVE MAP 35210 AND MODIFICATION M78-57 ON APPEAL FROM THE PLANN- ING COMMISSION TO CONVERT THE EXISTING APART- MENT PROJECT AT 1122-1126-1128 FAIRVIEW AVENUE INTO A CONDOMINIUM THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY FIND, RESOLVE AND DETERMINE AS FOLLOWS: SECTION 1. On May 9, 1978, the Arcadia City Planning Commission voted 4 to 0 to deny Tentative Map (TM) 35210 and Modification M-78-57 to convert the existing apartment project at ll22-1l26-ll28 Fairview Avenue into a 26 unit condominium. SECTION 2. The applicant and owner, J.O. Vandervoort, amended both applications and appealed the decision of the Plann- ing Co~ission to the Arcadia City Council and a duly noticed public hearing was held on said appeal before the City Council on July 5, 1978, at which time all interested persons were given full opportunity to be heard and present evidence. SECTION 3. We hereby find the facts stated in the July 5, 1978 Planning Department Memorandum on these applications, as amended, submitted to the City Council to be true and correct. SECTION 4.. That we hereby approve the negative declarations for T 35210 and M-78-57 and find that these projects will not have a significant effect on the environment. make SECTION 5. That as to the amended applications we the following findings of fact: a. That all nonconformities with hereby are minor and that they will not prevent and purpose of development standards. b. That the granting of the requested secure an appropriate improvement the development compliance with standards the spirit modifications will -1- 4763 c. That the aforesaid tract is consistent with the Arcadia General Plan and that the waste discharge from said tract would not result in a violation of the existing requirements set forth in the Water Code. SECTION 6. That we hereby authorize the Director of Public Works to approve and execute the Subdivision Agreement for TM 35210; and approve the application for TM35210 and M-78-57 as amended by the applicant, subject to the following conditions: a. Conditions as outlined in the April 25, 1978 report from the Department oj' Public Works shall be complied with to the satis- faction of the Director of Public Works. b. That the final map shall not be approved unless the pro- ject complies with all current building codes and zoning regulations as required by Arcadia Municipal Code Section 9111.6. c. That eac,h of the tenants of the proposed condominium or community apartment house project has been or will be given 120 days written notice of intention to convert prior to termination of tenancy due to the conversion or proposed conversion. The pro- visions of this subdivision shall not alter or abridge the rights or obligations of the parties in performance of their covenants, including, but not limited to the provision of services, payment of rent or the obligations imposed by Section 1941, 1941.l and 1941.2 of the Civil Code. d. That each of the tenants of the proposed condominium or community apartment house project has been or will be given notice of an exclusive right to contract for the purchase of their res- pective units upon the same terms and conditions that such units will be initially offered to the general public or terms more favorable to the tenant. The right shall run for a period of not less than 60 days from the date of issuance of the subdivision public report pursuant to Section 110l8.2 of the Business and Professions Code, unless the tenant gives prior written notice of his intention not to exercise the right. -2- 4763 e. That the dwelling unit over the garages as shown on the second floor site plan of the revised Tentative Map 35210, which is attached hereto as Exhibit A and by this reference incorporated herein, be converted into a recreation room owned in common by the proposed condominium owners' association. f. That the area east of the garages as shown on the first floor site plan of the revised Tentative Map 35210 be designated and marked as a parking stall. SECTION 7. The City Clerk shall certify to the adoption of the Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 18th day of July ,1978, by the affirmative vote of at least three Council members, to wit: i AYES: Councilmen Pellegrino, Saelid and Parry NOES: Councilman Margett ABSENT: None ABSTAIN: Councilman Gilb SIGNED AND APPROVED this 18th day of July . 1978.
