HomeMy WebLinkAbout4783 RESOLUTION NO. 4783 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA GRANTING CONDITIONAL USE PERMIT 78-13 FOR A PRIVATE HIGH SCHOOL AT SOl NORTH SANTA ANITA AVENUE WHEREAS, on July 28,' 1978, an application was filed by Maranatha High School, hereinafter referred to as "Maranatha", for a private high school, Planning Department Case No. C.U.P. 78-13, on the property commonly known as 501 North Santa Anita Avenue, hereinafter referred to as "Property", more particularly described as follows: Lot 26 and portion of Lot 15, Tract 17329, and those portions of Windsor Road and Cornell Drive vacated by Arcadia City Ordinance No. 873, in the City of Arcadia, County of Los Angeles, as per map recorded in Book 446, pages 26-27, of maps, in the office of the Recorder of said County; and WHEREAS, a public hearing was held before the Arcadia City Planning Commission on August 22, 1978 at which time all interested persons were given full opportunity to be heard and to present evi- dence, and which aforesaid permit was approved pursuant to its Resolution No. l065 by a 5-0 vote; and WHEREAS, the City Council duly noticed a public hearing on said application for October 3, 1978, to which all persons owning property within a 300 ft. radius of said Property were mailed notices in accordance with the requirements of Arcadia Municipal Code Section 9275.2.4 and at which hearing all interested persons present were given full opportunity to be heard and to present evidence. NOW, THEREFORE, the City Council of the City of Arcadia does hereby resolve and determine as follows: Section 1. That we hereby make the following findings of fact: A. That the factual data submitted by the Planning Department in its October 3, 1978 report and attachments thereto are hereby found to be true and correct and are by this reference incorporated herein as though fully set forth. B. That Maranatha has prohibited student parking on subject Property and student and faculty parking on the streets adjoining -1- 4783 subject Property, which prohibition has eliminated traffic and parking congestion in the surrounding neighborhood' street,s. C. That with the imposition .of conditions'of approval contained herein that traffic and parking congestion in the sur- rounding neighborhood will be mitigated and the proposed use will therefore not have a significant effect on the environment. D. That there are persons living in surrounding neighborhood who favor the granting of said permit. E. The granting of a Conditional Use Permit as herein provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. F. The use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. G. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards,parking, loading, land- scaping and other features required to adjust said use with the land and uses in the neighborhood. H. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed Use. I. The granting of such Conditional Use Permit will not ad- versely affect the General Plan. Section 2. That the City Council, based on the foregoing find- ings of fact, grants Conditional Use Permit 78-13 to continue a private high school at 501 North Santa Anita Avenue upon the follow- ill.g conditions: 1. The Property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 78-13 and applicable regulations of the Arcadia Municipal Code. 2. Parking permits, to be issued by the school, shall not exceed the number of parkin~ spaces. Students and faculty. from the school Shall not park on Cornell Drive, Windsor Road, or Newman Avenue. 3. The ma:dmum number of students attending classes on Property shall not exceed 275. -2- 4783 v 4. No outdoor physical education activities shall be per- mitted on Property. 5. That a traffic and parking management plan for all prop- erties in Arcadia used by Maranatha be submitted for review by Public Works, Fire Department, Police Department and the Planning Department and be approved by the Planning Commission. Maranatha mUst submit the aforesaid planes) by January 1, 1979. Maranatha shall comply with said plan thereafter at all times. There shall be no ingress to Property from Cornell Drive, Windsor Road or Newman Avenue. Egress from Property shall be only onto Cornell Drive, Windsor Road or Newman Avenue. 6. That use of the school facility is limited to the applicant. 7. Maranatha students shall not park on or adjacent to Property at any time between 6 o'clock A.M. and 2:50 o'clock P.M. on any day school is in session on Property. Section 3. The City Clerk shall certify to the adoption of this Resolution.
