RESOLUTION NO. 4807
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA FIXING THE UNIFORM RATES CHARGEABLE FOR
THE COLLECTION, HAULING AND DISPOSAL OF RESIDEN-
TIAL REFUSE IN THE CITY OF ARCADIA AND REPEALING
RESOLUTION NO. 4461 IN PART
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to the provisions of Chapter 1 of Article
V of the Arcadia Municipal Code, the City Council of the City of
Arcadia does hereby fix and determine the following uniform rates for
the collection. hauling and disposal of residential refuse in the
City of Arcadia. The rates hereby fixed and determined shall remain
in effect until changed by the City Council by resolution. No rates
shall be charged or collected other than the rates hereby fixed and
determined.
SECTION 2. The following uniform rates are hereby fixed for
single-family dwellings:
For the regularly scheduled pickup once a week from curb or
alley of residential refuse in unlimited quantities, including all
large objects such as couches, refrigerators, rugs, water heaters,
washing machines and other such large items, three and 20/100 dollars
($3.20) per month.
SECTION 3. The fOllowing uniform rates are hereby fixed for
multiple-family detached dwellings consisting of two or three detached
dwelling units on one lot:
For the regularly scheduled pickup once a week from curb or
alley of residential refuse in unlimited 9uantities, including all
large objects such as couches, refrigerators, rugs, water heaters,
washing machines and other such large items, three and 20/100 dollars
($3.20) per month for the first dwelling unit, and one and 60/100
dollars ($1.60) per month for each additional dwelling unit to be
paid for by the landlord or his designated agent.
SECTION 4. The following uniform rates are hereby fixed for
multiple-family dwellings containing from two (2) to nine (9) dwell-
ing units:

For the regular scheduled pickup once a week from curb or
alley of residential refuse in unlimited quantities, including all
large objects such as couches, refrigerators, rugs, water heaters,
washing machines and other such large items one and 70/100 dollars
($1.70) per month per dwelling unit (whether occupied or not) for
service on an annual basis, paid for by the landlord or his designated
agent.
SECTION 5. The fOllowing uniform rates are hereby fixed for

multiple-family dwellings containing ten (lO) or mor~ dwelling units:
For regularly scheduled pickup twice a week from curb or alley
of residential refuse in unlimited quantities, including all large
objects such as couches, refrigerators, rugs, water heaters, washing
machines and other such large items, two and 10/100 dollars ($2.10)
per month per dwelling unit (whether occupied or not) for service on
an annual basis, paid for by the landlord or his designated agent.
SECTION 6. The following uniform rates are hereby fixed for
backyard pickup of residential refuse:
For regularly scheduled pickup once a week from a backyard
where the distance between place of pickup and the nearest public
street or alley is one hundred fifty (150) feet or less, of residential
refuse, not to exceed one and one-half (1-1/2) loose cubic yards or one
hundred fifty (150) pounds, (approximately four 35 gallon cans), seven
and 20/100 dollars ($7.20) per month for service on an annual basis.
For each additional one hundred fifty (150) feet or portion thereof,
or for each additional one and one-half (l-l/2) loose cubic yards or
one hundred fifty (150) pounds or portion thereof, provided that an
additional charge shall not be made for both additional quantity and
additional distance, seven and 20/100 dollars ($7.20) per month.
SECTION 7. The following uniform rates are hereby fixed for
containers for mechanical loading of refuse:
A. Three (3) cubic yard capacity, rental of eleven and nO/lOO
dollars ($11.00) per month per container.
B. One and one-half (1-1/2) cubic yard capacity, rental of
nine and no/lOO dollars ($9.00) per month per container.
C. One (1) cubic yard capacity, rental of nine and nO/lOO
dollars ($9.00) per month per container.

SECTION 8. The fOllowing uniform rates are hereby fixed for
special services:
A. For the special pickup of residential refuse from single-
family dwelling units at times and dates other than the
regularly scheduled pickup, five and no/lOa dollars ($5.00)
per pickup.
B. For the one-time delivery and pickup of a container for
mechanical loading of refuse, eighteen and no/lOO dollars
($18.00)
C. For the special pickup of a container for mechanical load-
ing of refuse at times and dates other than the regularly
scheduled pickup, eighteen and nO/lOO dollars ($18.00) per
pickup.
SECTION 9. The City Manager shall have authority to settle all
disputes between the City and the authorized residential refuse
collector concerning rates and containers, and his decision shall be
final subject only to appeal to the City Council.
SECTION lQ. "Regularly scheduled pickup" shall mean the pickup
at the times and dates specified by the City Manager pursuant to
Chapter 1 of Article V of the Arcadia Municipal Code.
SECTION 11. That Sections 1 through 10 of Resolution'No. 4461
of the City Council of the City of Arcadia are hereby repealed effective
March l, 1979.
SECTION 12. This Resolution shall become effective and operative
on March l, 1979.
SECTION 13. Neither the adoption of this Resolution nor the
repeal hereby of any resolution shall in any manner be construed as
affecting any of the provisions of such resolution relating to the
collection of any such fee, nor to affect the validity of any bond
or cash deposit in lieu thereof, posted, filed or deposited therefore
and all rights and obligations thereunder appertaining shall continue
in full force and effect.
SECTION 14. If any section, subsection, sentence, clause,
phrase or portion of this resolution is, for any reason, held to

be invalid or unconstitutional by the decision of any court of com-
petent jurisdiction, such decision shall not affect the validity of
the remaining portions of this resolution. The City Council of the
City of Arcadia hereby declares that it would have adopted this
resolution and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that anyone or more sections,
subsections. sentences, clauses, phrases or portions be declared in-
valid or unconstitutional.
SECTION 15. The City Clerk shall certify to the adoption of
this Resolution.
