HomeMy WebLinkAbout4809 RESOLUTION NO. 4809 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA APPROVING A MAP AND DECLARING INTENTION TO VACATE AND ABANDON A PORTION OF WHEELER AVENUE: DIRECTING THE CLERK OF THE COUNCIL TO FILE SAID MAP IN HER OFFICE DESCRIBING SAID PORTION, RESERV- ING EASEMENTS AND RIGHTS-OF-WAY TO BE EXCEPTED; SETTING A PUBLIC HEARING THEREON FOR FEBRUARY 20, 1979; AND DIRECTING NOTICE HEREOF TO BE POSTED AND PUBLISHED THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1. This City Council of the City of Arcadia does' here": by approve that certain map showing the proposed street abandonment of a portion of Wheeler Avenue, attached hereto as Exhibit "A", as the map showing aforedescribed street portion which this Council hereinafter declares its intention to vacate and abandon subject to the reservation and exception of certain easements and rights-of-way hereinafter described. Section 2. The City Clerk is hereby directed to file said map in her office where the same may be examined by any and all persons desiring to do so. Section 3. Pursuant to and in accordance with provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, this Council does hereby declare its intention to order the vacation'and abandonment of, and to vacate and abandon that portion of Wheeler Avenue, subject to the easements and rights- of-way hereinafter described and hereby finds that the pUblic con- venience and necessity require the reservation of the easements and rights-of-way hereinafter described. Section 4. Notice is hereby given that at the hour of 7:30 PM or as soon thereafter as the matter can be heard, on the 20th day of February, 1979, in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, a public hearing will be held by this Council at which time any and all persons in- terested in or objecting to the proposed vacation and abandonment -1- 4809 and the reservations and exceptions of the easements and rights- of-way hereinafter described may appear and be heard. Section 5. The Clerk of the Council is hereby directed to cause the Resolution to be published in the official newspaper of the City of Arcadia within fifteen (15) days after the date of adoption of this Resolution and at least ten (10) days before the date set for said hearing. Section 6. The Director of Public Works is hereby directed to cause notices of said proposed street vacation and abandonment to be posted conspicuously along the line of the portion of the street hereinafter described, which is proposed to be vacated and abandoned at least ten (10) days before the date set for said hearing. Such notices shall be posted not more than three hundred feet (300') apart, but"at least three (3) shall be posted. Such notices shall state the passage of this Resolution of Intention and the time and place of the hearing. Section 7. Said portion of the street proposed to be vacated and reservations of easements and rights-of-way are more fully described in Exhibit "B", which is attached hereto and by this reference incorporated herein. Section 8. The City Clerk shall certify to the adoption of this Resolution. I'{' l, ' \~ :> Reserving and excepting to the City of Arcadia the permanent easement and ,right at any time, or from time to time, to construct, maintain, operate, replace, remove, anG renew sani- tary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, re- new, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, raiiroad lines, and for the transportation or distribution of electric energy, petrOleum and it~ products, ammonia, water, and incidental purposes, including access and the right to keep 'the property free from inflammable materials, and wood, growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated.
