SUMMARY
Based upon the Public Works Services Department's proposed 2012-13 Operating Budget,
Capital Improvement Plan, Water Master Plan, and Sewer Master Plan, it is recommended
that the City Council adjust the water and sewer rates by the Consumer Price Index (CPI) of
2.0% for Fiscal Year 2012-13. In addition, Waste Management, Inc. (WM), has submitted a
request to adjust single family and multi-family refuse rates by 1.89% based on the rate
formula established in the Residential Refuse and Recycling Agreement between the City of
Arcadia and Waste Management, Inc. Even with the proposed increases, water, sewer,
and refuse rates paid by Arcadia Property Owners will be among the lowest in the region.
The proposed monthly rate adjustments are as follows:

Therefore, it is recommended that the City Council approve water, sewer, and refuse rate
adjustments for Fiscal Year 2012-13 by adopting Resolution No. 6831, Resolution No.
6832, and Resolution No. 6833.
BACKGROUND
On June 16, 2009, the City Council approved a five (5) year rate increase schedule for
water and sewer rates based on the previous year's Consumer Price Index (CPI). This will
be the fourth (4) year of an approved five (5) year CPI rate adjustment for water and sewer
rates. Accordingly, the City had taken the necessary steps to be in compliance with
Proposition 218, which included public notification, balloting, and holding of a public
hearing. Adopting a five (5) year rate schedule based on CPI adjustments saves the City
approximately $15,000 annually for not having to print and mail notices and ballots.
For water and sewer rates, the March 2011 — March 2012 Los Angeles-Riverside-Orange
County Urban Wage Earners and Clerical Workers' California Consumer Price Index (CPI)
change is used as the basis for determining rate increases. CPI is reliable statistical data
published by the California Department of Industrial Relations. CPI is a measurement of the
cost of a good from one time period to another, which makes it an acceptable practice to
base rate adjustments on. Labor and materials are the main components of operating the
water and sewer system.
For residential and multi-family refuse rates, the annual adjustment is based on the
negotiated rate-adjustment calculation in accordance with the Residential Refuse and
Recycling Agreement that was awarded by the City Council on February 3, 2009. Part of
this agreement established the residential and multi-family refuse rate schedule for Fiscal
Years 2009-10 and 2010-11. Subsequently, following Proposition 218 compliance
requirements, the City Council approved a similar five (5) year refuse rate adjustment on
June 7, 2011, not to exceed the contractual rate adjustment formula. This will be the
second (2) year of the approved five (5) year rate adjustment schedule for single family and
multi-family rates.
If an extraordinary increase that exceeds CPI or the agreed-upon rate adjustment formula
under the Residential Refuse and Recycling Agreement occurs, then the City must follow
Proposition 218 requirements and send out notices, ballots, and hold a public hearing.
DISCUSSION
Water Rates
Water rates are determined by analyzing the current and projected annual cost to operate
and maintain the City's water supply and distribution system (Water System); provide for
improvements to the water system infrastructure through capital improvements; replace
equipment used in the maintenance of the water system; and maintain reserve funds as
directed by the City Council to offset costs in the event of a catastrophic event or
emergency that would affect the water system (see Exhibit 1 for Water Fund Balance).

Operations and maintenance comprise the majority of the expense of the Water System
budget and providing for the supply of water comprises the majority of the operating
expense. Water is supplied to the Water System entirely from groundwater, pumped from
two underground aquifers referred to as groundwater basins (basins). These basins are the
Raymond Basin and the Main San Gabriel Basin (Main Basin).
Pumping rights in the Raymond Basin have been established by legal judgment and are
fixed annually. Pumping rights in the Main Basin have also been established by legal
judgment and are based on a percentage of the total amount of water that is available to be
pumped from the basin for that year. The Main Basin sets this limit, known as the
Operating Safe Yield (OSY) each year. If an agency pumps more than their allowed right,
they are required to pay the Main Basin for water to be imported from the Metropolitan
Water District to supplement the excess amount pumped. This is referred to as
"replenishment water". The cost for replenishment water has risen significantly over the
past five (5) years. For FY 2011-12 the cost for replenishment water was $640 per acre
foot or $1.47/CCF (748 gallons). The cost of replenishment water for FY 2012-13 is
tentatively set at $696 per acre foot or $1.60/CCF (748 gallons).
In preparation of the FY 2012-13 budget, each account has been evaluated, and where
possible, operation and maintenance expenditures have been reduced while continuing to
maintain the reliability of the water system, complying with water quality standards and
retaining the existing level of service.
The value of the City's water system is estimated at $200 million and industry standards
recommend a ten percent (10%) reserve to offset costs in the event of a catastrophic event
or emergency that would affect the water system's infrastructure. This proposed rate
adjustment is predicated on an annual operating budget, and a reserve level of twenty-five
percent (25%) of the operations and maintenance budget, capital improvement projects
outlined in the Water Master Plan Update, and maintenance of a $20 million fund reserve
following the completion of the projects.
Therefore, it is recommended that the City Council approve a 2.0% CPI rate increase in
water rates for Fiscal Year 2012-13 based on the March 2011 — March 2012 Los Angeles-
Riverside-Orange County Urban Wage Earners and Clerical Workers' California Consumer
Price Index change. This would change the existing water rate from $1.34 to $1.37 per 100
cubic feet (748 gallons).
A survey of water rates has been conducted for neighboring agencies and found that even
with the proposed water rate adjustment, the City of Arcadia's water rates continue to
remain among the lowest (Exhibit 2).
Sewer Rates
The Sewer Master Plan is a comprehensive report outlining a long-range program of capital
improvements and preventative maintenance measures to upgrade and maintain the City's
sewer system. The Sewer Master Plan Update and Hydraulic Modeling Report evaluates
the adequacy of the City's wastewater collection system through the Year 2026.

The City's sewer pipes are on average, fifty (50) years old and include 138 miles of pipe
throughout the City. The rate adjustments are necessary to fund the operations and
maintenance activities of the sewer system to ensure that the City's sewer system is in
compliance with State Regulations that mandate the elimination of sewer overflows. In
2006, the City was required by state law to develop and submit a Sewer System
Management Plan (SSMP) to the State Water Resources Control Board, which also
required the City to retain a permit for its sewer system. This Plan was approved by the
City Council in November 2007.
Accordingly, the Sewer Master Plan proposes annual rate adjustments in order to recover
operational sewer service costs, pay for the Water Discharge Requirement (WDR) permit
fee, fund Capital Improvement Projects and build a $5 million dollar fund reserve to be used
in case of an emergency or catastrophic event (see Exhibit 3 for Sewer Fund Balance).
It is recommended that the City Council approve a 2.0% CPI rate increase in sewer rates for
Fiscal Year 2012-13 based on the March 2011 — March 2012 Los Angeles-Riverside-
Orange County Urban Wage Earners and Clerical Workers' California Consumer Price
Index change.
This proposed sewer rate adjustment would change the existing residential rate from $4.03
to $4.11 per month per dwelling unit, reflecting a $0.08 increase monthly or $0.96 annually.
The proposed rate adjustment for the commercial rate would change from $12.06 per month
for each sewer connection and an additional $0.12 per 100 cubic feet of water used per
month to $12.30 per month for each sewer connection and an additional $0.12 per 100
cubic feet of water used per month.

with the proposed sewer rate adjustment, the City of Arcadia's sewer rates continue to
remain among the lowest (Exhibit 4).
Refuse Rates
In accordance with the Residential and Recycling Agreement, Waste Management Inc.
(WM) is entitled to receive annual rate adjustments that are subject for staff review and City
Council's approval. The rate increase is based on a rate adjustment formula consisting of
three (3) weighted indices:
• Consumer Price Index (CPI) (65%)
• Disposal/Green Waste Facility Index (30%)
• Producer Price Index (PPI) for fuel (5%)
The CPI change was measured from the annual average for calendar year 2010 and 2011
specific to the Los Angeles-Riverside-Orange County statistical area. The Disposal/Green
Waste Facility index is adjusted based on per ton tipping fee charged at the Los Angeles
County Sanitation District disposal and composting facilities. Additionally, the
Disposal/Green Waste index is further broken down to the percentage of trash and
greenwaste the City disposed of at local landfills. Finally, the Producer Price Index (PPI) for
fuel is calculated based proportionally on the fuel used by the vehicles in service as
published by the United States Department of Energy.

For single family, the rate will increase by 1.89% or $0.38, changing the standard monthly
service from $20.21 to $20.59 (this does not include the $0.30 AB 939 fee or the $0.78
recycling fee). Therefore, residents with standard monthly service would be billed a total of
$65.01 every three (3) months instead of $63.87, showing an increase of $1.14 every three
(3) months, or $4.56 annually. Likewise, multi-family refuse rates will be increased by
1.89%. For example, a multi-family property with a 3-cubic yard bin service that is picked
up once a week will have a rate increase of $2.31, changing their standard monthly service
rate from $125.44 to $127.82.
Staff worked with Waste Management representatives and thoroughly reviewed and verified
all rate adjustment data. Table 1 below shows the percentage breakdown and weighted
amount that is accounted for in each index that make up the total CPI adjustment:

WM has successfully demonstrated their commitment to working with the City and their
ability to provide the most efficient and effective refuse and recycling services. Based on
the contractor's service record and continuing satisfactory performance, it is recommended
that the City Council approve WM's request for a refuse rate increase of 1.89% for Fiscal
Year 2012-13.
A survey of residential refuse rates has been conducted for neighboring agencies and found
that even with the proposed refuse rate adjustment, the City of Arcadia's refuse rates
continue to remain among the lowest in the San Gabriel Valley (Exhibit 5).

FISCAL IMPACT
Water and sewer rates increases are necessary to fund the Capital Improvement Program
and the Operating Budget, and to maintain a reserve fund balance in case of a natural
disaster or emergency. The lack of a rate increase would not allow the City to recover
increasing operations and maintenance costs of running the City's water and sewer system.
Residential refuse and recycling collection service rate is a fee-for-service that is paid
directly to the contractor by the residential customer. There is no impact to the City's
budget with the proposed residential refuse rates increase.
RECOMMENDATION
1. Adopt Resolution No. 6831 setting the water rate schedule for Fiscal Year
2012-13.
2. Adopt Resolution No. 6832 setting the sewer rate schedule for Fiscal year
2012-13.
3. Adopt Resolution No. 6833 setting the residential refuse rate schedule for
Fiscal Year 2012-13.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY ARCADIA,
CALIFORNIA, SETTING CITY WATER RATES AND FINDING THE
RATES WILL NOT EXCEED THE ESTIMATED AMOUNT
NECESSARY TO FUND OPERATION OF THE CITY WATER
SYSTEM
WHEREAS, pursuant to the Arcadia Municipal Code Section 7531.1, water rates
may be set and modified by resolution of the City Council; and
WHEREAS, it is the desire of the City Council to maintain flexibility so as to best
meet the needs of the City and water consumers; and
WHEREAS, proposed water rate changes were presented to the City Council at
its June 5, 2012 regularly scheduled City Council meeting; and
WHEREAS, a public notice concerning said rate changes was duly mailed to
residents in accordance with Proposition 218 noticing requirements in April 2009, and a
duly noticed public hearing concerning said rate adjustments was conducted by the City
Council on June 16, 2009 for Fiscal Years 09/10, 10/11 , 11/12, 2/13 and 13/14.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. RATES INSIDE THE CITY. The following rates are established for
the provision, delivery, and consumption of water for beneficial use inside the City
during each bimonthly period:

SECTION 2. RATES OUTSIDE CITY. The bimonthly rates for metered services
and for all other purposes for which no other rate is specified for water put to or made
available for beneficial use outside the City and served or to be served through a meter,
shall be as follows:

SECTION 5. All rates set forth in this Resolution shall be reflected on all

SECTION 6. Water rates for the following fiscal year, 2013/14, shall
automatically be adjusted annually based on the Los Angeles—Riverside-Orange County
Urban Wage Earners and Clerical Workers Consumer Price Index. Annually adjusted
rates shall take effect for all water service appearing on water bills issued on July 1 or
thereafter of each year.
SECTION 7. The City Council hereby finds that the rates specified in this
Resolution will not produce an amount in excess of that necessary to fund the operation
of the City of Arcadia Water System.
SECTION 8. The City Council finds that this Resolution is exempt from the
requirements of the California Environmental Quality Act as specified in Title 14 Section
15273 of the California Administrative Code.
SECTION 9. The City Clerk shall certify to the adoption of this Resolution.

amount and so as to meet the capital improvement and service needs of the City and its
sewer service consumers; and
WHEREAS, proposed sewer rate changes were presented to the City Council at
its June 5, 2011 regularly scheduled City Council meeting; and
WHEREAS, a public notice concerning said rate changes was duly mailed to
residents in accordance with Proposition 218 noticing requirements in April 2009, and a
duly noticed public hearing concerning said rate adjustments was conducted by the City
Council on June 16, 2009 for Fiscal Years 09/10, 10/11, 11/12, 12/13 and 13/14.

(c) Commercial Properties- $12.30 per month sewer connection charge and
an additional $0.12 per 100 cubic feet of water used per month.

(d) Premises where sewer connections are not available or are not connected
shall be exempt from said monthly charges.
SECTION 2. The City Council hereby finds that the rates specified in this
Resolution will not produce an amount in excess of that necessary to fund the operation
of the City of Arcadia Sewer System.
SECTION 3. All rates set forth in this Resolution shall be reflected on all sewer
bills issued on and after July 1, 2012.
SECTION 4. Sewer rates for the following fiscal year, 2013/14, shall
automatically be adjusted annually based on the Los Angeles-Riverside-Orange County
Urban Wage Earners and Clerical Workers Consumer Price Index. Annually adjusted
rates shall take effect for all sewer service appearing on sewer bills issued on July 1 or
thereafter of each year.

RESOLUTION NO. 6833
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, SETTING THE SERVICE RATES FOR THE COLLECTION
OF RESIDENTIAL REFUSE AND RECYCLABLES PURSUANT TO
SECTION 5120.7 OF THE ARCADIA MUNICIPAL CODE
WHEREAS, pursuant to the Arcadia Municipal Code Section 5120.7, the Arcadia
City Council is authorized to fix and determine the rates that may be charged for
collecting or removing garbage, refuse or recyclables from any premises in the City; and
WHEREAS, all residential units in the City are required to participate in the City's
refuse collection service; and
WHEREAS, the franchisee under that certain Residential Refuse and Recycling
Agreement dated March 10, 2009 is not authorized to charge or collect any fees or rates
other than the fees and rates set forth in this Resolution and the fees and rates shall
remain in effect, unless changed by resolution of the City Council of the City of Arcadia;
and
WHEREAS, the proposed refuse rate change was presented to the City Council
at its June 5, 2012 regularly scheduled City Council meeting; and
WHEREAS, a duly noticed public hearing concerning the rate adjustment was
conducted by the City Council on June 7, 2011 in accordance with Proposition 218
requirements to take effect in subsequent fiscal years beginning Fiscal Year 2011/2012,
including an automatic annual rate adjustment for Fiscal Years 2012/2013, 2013/2014,
2014/2015, and 2015/2016. The rate adjustments are based on a formula using the
Consumer Price Index (CPI), Disposal/Green Waste Facility Index, and Producer Price
Index (PPI) for fuel, in accordance with the City's Residential Refuse and Recycling
Agreement with Waste Management.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. Commencing July 1, 2012, the monthly rates for residential refuse
and recycling collection services for Fiscal Year 2012/13 shall be those set forth in
Exhibit "A" attached hereto.
SECTION 2. All rates set forth in this Resolution shall be reflected on all refuse
bills issued on or after July 1, 2012.
SECTION 3. Residential refuse rates for the collection of residential refuse and
recyclables for Fiscal Years 2013/2014, 2014/2015, and 2015/2016 shall automatically
be adjusted annually based on the formula described in the recitals of this Resolution
using the Consumer Price Index (CPI), Disposal/Green Waste Facility Index, and
Producer Price Index (PPI) for fuel. Annually adjusted rates shall take effect and be
reflected on all refuse bills issued on and after July 1 of each year.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
