RESOLUTION NO. 5365
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA ESTABLISHING A TWO-HOUR PARKING LIMITATION AND
TOW-AWAY ZONE IN OFFSTREET PARKING FACILITIES PURSUANT TO
CALIFORNIA VEHICLE CODE SECTIONS 21113 (a), (c) AND 22519
IN THE CITY OF ARCADIA ROSE GARDEN PARKING LOT
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. As referred to in this Resolution, City of Arcadia Rose
Garden Parking Lot shall refer to that certain parking area owned and operated
by the City of Arcadia between Huntington Drive on the north, Holly Avenue on
the west, Campus Drive on the south and Arcadia County Park on the east; as
depicted on Exhibit A attached hereto.
SECTION 2. Pursuant to California Vehicle Code Sections 21113 (al,
(c), 22519 and Section 11.3 of the Uniform Traffic Ordinance of the City of
Arcad i a, adopted by Sect i on 3211 of the Arcad i a Mun i c i pa 1 Code, no person
shall park, stand or stop any vehicle in the City of Arcadia Rose Garden
Parking Lot for a period in excess of two (2) hours. Violators shall be
subject to towing. The City Engineer of the City of Arcadia is hereby
authorized and directed to post signs containing the prohibition set forth
above.
SECTION 3. If any section, subsection, sentence, clause, phrase or
portion of this Resolution is, for any reason, held to be invalid or
unconstitutional by the decision of any court of competent jurisdiction, such

decision shall not affect the validity of the remaining portions of this
Resolution. The City Council of the City of Arcadia hereby declares that it
would have adopted this Resolution and each section, subsection, sentence,
clause, phrase or portion thereof, irrespective of the fact that anyone or
more sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional,
SECTI ON 4. Nei ther the adoption of th i s Reso 1 ut i on nor the repea 1
hereby of any resolution shall in any manner affect the prosecution for
violation of law, which violations were committed prior to the effective date
hereof, nor be construed as affecting any of the provisions of such law
relating to the collection of any such license or penalty or the penal
provisions applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in 1 ieu thereof, required to be posted, filed or
deposited pursuant to any law and all rights and obligation thereunder
appertaining shall continue in full force and effect.
SECTION 5, That the City Clerk shall certify to the adoption of
this Resolution.
