HomeMy WebLinkAbout4958 RESOLUTION NO. 4958 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA MAKING FINDINGS OF LOCAL CONDITIONS NECESSITATING THE CHANGES AND MODIFICATIONS MADE BY THE ARCADIA MUNICIPAL CODE TO THE UNIFORM BUILDING CODE, 1979 EDITION, UNIFORM MECHANICAL CODE, 1976 EDITION, WITH MODIFICATIONS, AS SET FORTH IN CITY OF ARCADIA ORDINANCE NO. l719. BE IT RESOLVED AND DETERMINED BY THE ARCADIA CITY COUNCIL that we hereby make the following findings of local conditions necessitating the changes and modifications made by the Arcadia Municipal Code (here- inafter referred to as the AMC) to the Uniform Building Code (herein- .after referred to as the UBC), 1979 Edition, Uniform Mechanical Code (hereinafter referred to as the UMC), 1976 Edition, with modifications, as set forth in Ordinance No. l7l9 of the City of Arcadia: SECTION 1. That there exists a local condition consisting of a hillside area of varied geologic composition as well as an active fault trace within the City of Arcadia necessitating the amendment of UBC S700l by AMC S8130.21; the addition of UBC S7003.10 and S7003.11 by AMC 58130.22; the amendment of UBC S7006(b ) by AMC 58130.23; the addition of UBC S7006.1 by AMC 58130.24; the addition of UBC S7006.2 by AMC 58130.25; the amendment of UBC 57007(a) and (b) by AMC 58130.26; the amendment of UBC S7013 by AMC 58130.27; the addition of UBC 57013(c) by AMC S8130.28, (substantive parts of which preexisted November 23, 1970 and were revised for consistency December 21, 1971 and May 3, 1977.) SECTION 2. That there exist semi-arid local conditions requiring cooling systems to meet specific criteria in order to provide for a healthy living environment and reduction in long-term energy demands, necessitating addition of Sl306.2 to Part III, Chapter l3 of the UBC by AMC S8130.10. SECTION 3. That there exist local soil conditions requiring specific paving and preparation in order to provide for adequate driving surfaces for multiple family dwelling units, necessitating addition of S1308 to the UBC by AMC 58130.10. -1- 4958 SECTION 4. That there exist local semi-arid and fire hazard conditions and high rise buildings requiring more effective building fire protection systems, necessitating addition of 51210(c) to the UBC by AMC 58130.9; the amendment to UBC 51807 by AMC 58130.13; UBC 53205(b) by AMC 58130.17; UBC 5 3703(f) by AMC 58130.18; UBC 53802 by AMC 58130.19, (substantive parts of which preexisted November 23, 1970, and were revised for consistency December 21, 1971 and May 3, 1977.) SECTION 5. That there exist substantially increased noise levels throughout the City resulting from a freeway, railroad, regional shopping center, and Santa Anita Race Track, necessitating the following changes and modifications which require the diminution of noise levels: adding 51305.1 to the UBC by AMC 58130.10 and by adding UBC 51310 by AMC 58130.10. SECTION 6. That there exist local semi-arid fire hazard con- ditions, high rise buildings, varied geologic composition conditions, and an active earthquake fault trace, requiring greater fire safety in elevators, necessitating amendment of UBC 55103(f) by AMC 58130.20. SECTION 7. That there exist geologic composition conditions as well as an active fault trace requiring sheet vinyl on bathroom floors under carpeting, necessitating the addition" of 51302 to Part III, Chapter 13 of the UBC by AMC 58130.10. SECTION 8. That there exist local hillside areas, varied geo- logic composition conditions, as well as an active fault trace, soil erosion, semi-arid climate, occasional high wind condition, fire hazard conditions, and termite infested soils, requiring masonry and steel in lieu of wood by amending UBC 52308(b) by AMC 58130.14 (substantive parts of which preexisted November 23, 1970, and which was revised for typo- graphical clarification on December 21, 1971, and May 3, 1977 for UBC number consistency) and by deletion of Exception No. 1 of Subsection (b) of UBC 52907 by AMC 58130.16 (this deletion preexisted November 23, 1970 and was amended December 21, 1971, April 2, 1974, and May 3, 1977 for UBC number consistency.) -2- 4958 SECTION 9. That there exist local semi-arid fire hazard con- ditions, high density multiple family developments, varied geologic composition conditions, and an active earthquake fault trace, requiring greater fire safety in multiple family, commercial and industrial developments, necessitating amendment of UBC ~1704.2 and ~1704.3 by AMC 58130.12. SECTION lO. That the City Clerk is hereby instructed to file a certified copy of Ordinance No. l7l9 after its adoption, and a certified copy of this resolution with the California State Department of Housing and Community Development in Sacramento. SECTION ll. That the Clerk of the Council shall certify to the adoption of this resolution: I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 21st day of April, 1981 by the affirmative vote of at least three Councilmen, to wit: AYES: NOES, ABSENT, Councilmen Dring, Gilb, Haltom, saelid and Pellegrino None None SIGNED AND APPROVED this 21st day of April, 1981.
