RESOLUTION NO. 4987
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ~~CADIA GRANTING A CONDITIONAL USE PERMIT
TO UTILIZE CLASSROOMS FOR THE OPERATION OF A
PRESCHOOL AND -OTHER RELIGIOUS SCHOOL CLASSES
FOR TEMPLE SHAAREI TIKVAH SYNAGOGUE (AKA FOOTHILL
JEWISH TEMPLE AND CENTER) AND WAIVER OF WALL
HEIGHTH AND MATERIAL REQUIREMENTS OF ARCADIA
MUNICIPAL CODE SECTION 9275.5.6 AT 550 SOUTH
SECOND AVENUE, AND MAKING FINDINGS OF FACT.
WHEREAS, on June 24, 1981 an application was filed by Temple
Shaarei Tikvah Synagogue (AKA Foothill Jewish Temple and Center), to
utilize classrooms for the operation of a preschool and other re-
ligious school classes, Planning Department Case No. C.U.P. 81-7, on
the property conmonly known as 550 South Second Avenue, hereinafter
referred to as "property", more particularly described as follows,
A portion of Block 60, Santa Anita Tract, in the City of Arcadia,
County of Los Angeles, State of California, as per Map recorded
in Book 34, Pages 41 and 42 of Miscellaneous Records in the
Office of said County Recorder.
WHEREAS, a public hearing was held before the Planning Commission
on July 28, 1981 at which time all interested persons were given full
opportunity to be heard and to present evidence;
WHEREAS, on August 11, 1981 the Planning Commission adopted its
Resolution No. l173 granting aforesaid conditional use permit;
WHEREAS, on August 14, 1981 an "appeal" was filed with the Office
of the Mayor by Mrs. J. Nakov of 500 South Second Avenue;
WHEREAS, on August 18, 1981 the City Council by motion waived the
appeal fee for Mrs. J. Nakov
WHEREAS, the City Council gave its provisional approval for the
conditional use permit to expedite further processing of the pre-school
license application, subject to revocation. and set a public hearing
on said appeal for September 1, 1981;
WHEREAS, the City Council wishes to consider waiver of the wall
heighth and material requirements set forth in Arcadia Municipal Code
Section 9275.5.6;
WHEREAS, Arcadia Municipal Code Section 9275.9 authorizes waiver
of the height and material requirements provided the City Council holds
a noticed public hearing;

WHEREAS, the City Clerk duly gave notice of the September l, 1981
public hearing on the appeal of the conditional use permit and the
consideration of waiver of the wall heighth and material requirements.
as set forth in Exhibit "A" which is attached hereto:
WHEREAS, the City Council conducted aforesaid public hearing at
which time all interested persons were given opportunity to be heard
and to present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
HEREBY RESOLVE AND DETERMINE AS FOLLOWS,
SECTION 1. That we hereby make the following findings of fact,
A. That the factual data submitted by the Planning Department
in its July 28, 1981 and September l. 1981 reports and attachments
thereto. are hereby found to be true and correct and are by this
reference incorporated herein as though fully set forth.
B. That with the imposition of the conditions of approval
contained herein, that,
(l) The granting of a Conditional Use Permit and wall
heighth and material waivers as herein provided, will not be detri-
mental to the public health or welfare or injurious to the property
or improvements in such zone or vicinity.
(2) The use applied for at the location indicated is
properly one for which a Conditional Use Permit is authorized.
(3) The site for the proposed use is adequate in size and
shape to accommodate said use, including all yards, parking, loading,
landscaping and other features required to adjust said use with the
land and uses in the neighborhood.
(4) The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
(5) The granting of such Conditional Use Permit and wall
heighth and material waivers will not adversely affect the General
Plan.
(6) The granting of such Conditional Use Permit and wall
heighth and material waivers will not have a significant effect on
the environment.
SECTION 2. That the City Council, based on the foregoing findings
of fact, hereby approves and adopts the negative declaration for

C.U.P. 81-7, waives the wall heighth and material requirements set
forth in Arcadia Municipal Code Section 9275.5.6, and grants
Conditional Use Permit to utilize classrooms for the operation of
a preschool and other religious school classes for Temple shaarei
Tikvah Synagogue (AKA Foothill Jewish Temple and Center) upon the
following conditions:
1. That the enrollment to be limited to 30 students for the
preschool, 80 students for the afternoon religious classes, and
100 students for the Sunday School.
. 2. That enrollment may increase only with the review and
approval of a modified Conditional Use Permit by the City Council
to a maximum enrollment of 50 students for the preschool, 100 stu-
dents for the afternoon religious classes, and 125 students for the
Sunday School. The Applicant shall provide to the City Departments
any information required for their review. Any increase in enroll-
ment above the said maximum shall result in a new application for a
conditional use permit. If the Applicant is denied an increase in
enrollment by staff, the Applicant may appeal to the Planning Com-
mission by filing for a new conditional use permit.
3. That traffic ingress and egress from the property be con-
trolled to the satisfaction of the City Staff.
4. That C.U.P. 81-7 shall not take effect until the applicant
and owner have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.
SECTION 3. The City Clerk shall certify to the adoption of
this resolution.

I HEREBY CERTIFY that the foregoing resolution was adopted at a
reoular meeting of the City Council of the City of Arcadia held on the
1st day of September, 1981 by the affirmative vote of at least three
Councilmen, to wit:
