RESOLUTION NO. 4992
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA URGING ALL CITIZENS TO SIGN THE PETITION
AMENDING THE STATE OF CALIFORNIA CONSTITUTION BY
ADDING THE VICTIMS BILL OF RIGHTS.
WHEREAS, crime in the State has reached the point where it can
no longer be tolerated, and
WHEREAS, the laws protecting the citizens of California from
violent crime have proved to be too lenient.
NOW, THEREFORE, BE IT RESOLVED that the initiative petition now
being circulated, more commonly known as the Victims Bill of Rights,
sets certain new standards to be applied in dealing with perpetrators
of violent crimes, to wit:
SECTION 1. Provides that convicted criminals will be held
financially liable for their actions, and that victims will enjoy the
right to restitution.
SECTION 2. Provides that all students will have an inalienable
right to attend schools which are safe, secure, and peaceful.
SECTION 3. Makes it easier to collect and use evidence against
criminal defendents by conforming the State's exclusionary rule to the
U.S. Constitution.
SECTION 4. Makes public safety the main concern when setting
bail for granting release.
SECTION 5. Allows the use of prior felony convictions for
impeachment or enhancement of sentences, and provides longer prison
terms for serious, habitual offenders.
SECTION 6. Abolishes the diminished capacity or "Twinkie"
defense, and limits the use of insanity pleas.
SECTION 7. Gives victims the right to appear and testify at
sentencing and parole hearings for both juvenile and adult offenders.
SECTION 8. Prohibits plea bargaining for most serious felony
offenses.
SECTION 9. Cracks down on violent and habitual juvenile
offenders, and declares that for serious felony convictions, only
minors may be sent to California Youth Authority.

SECTION 10. Protects children and adults against sex offenders
by sending convicted offenders to prison.
SECTION 11. That the City Council of the City of Arcadia hereby
urges all Arcadia citizens and all citizens in the State of California
to sign this initiative petition so that we may more fully enjoy the
freedoms that were guaranteed to us.
SECTION 12. That the Clerk of the Council shall certify to the
adoption of this resolution.
