HomeMy WebLinkAbout6163 RESOLUTION NO. 6163 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING AND ADOPTING AN AMENDED APPENDIX TO THE CONFLICT OF INTEREST CODE PURSUANT TO THE POLITICAL REFORM ACT OF 1974 WHEREAS, the Legislature of the State of California enacted the Political Reform Act of 1974, Goyernment Code Section 81000 et seq. (the "Act"), which contains proyisions relating to conflicts of interest which potentially affect all officers, employees and consultants of the City of Arcadia (the "City"), and requires all public agencies to adopt and promulgate a Conflict of Interest Code; and WHEREAS, the City Council adopted a Conflict of Interest Code which was amended on October 7, 1997, by Resolution No. 6008, in compliance with Goyernment Code Section 81000 et seq.; and WHEREAS, subsequent changed circumstances within the City haye made it adyisable and necessary pursuant to Sections 87306 and 87307 of the Act to amend and update the Appendix to the City's Conflict ofInterest Code; and . WHEREAS, the potential penalties for yiolation of the proyisions of the Act are substantial and may include criminal and ciyil liability, as well as equitable relief which could result in the City being restrained or preyented from acting in cases where the proyisions of the Act may haye been yiolated; and 1 6163 WHEREAS, notice of the time and place of a public meeting on, and of consideration by the City Council of, the proposed amended Appendix was proyided each designated employee and publicly posted for reyiew at the offices of the City Clerk; and WHEREAS, a public meeting was held regarding the proposed amendment to the Conflict ofInterest Code at a regular meeting of the City Council on February 15, 2000, at which all present were giyen an opportunity to be heard on the proposed amended Appendix. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION I. The City Council does hereby approye and adopt the proposed amended Appendix to the City's Conflict ofInterest Code, a copy of which is attached hereto and shall remain on file with the City Clerk, together with the City's Conflict of Interest Code, and ayailable for inspection by the public. SECTION 2. The amended Appendix to the City's Conflict ofInterest Code shall become effectiye 30 days after the date of its adoption. 2 6163 SECTION 3. The City Clerk shall certifY to the adoption of this Resolution. Such written determination shall include a description of the consultant's duties and, based upon that description, a statement of the extent of disclosure requirements. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code. RVPUEJ\DMv\sS2108 5 EXHIBIT "B" DISCLOSURE CATEGORIES The disclosure categories listed below identifY the types of inyestments, business entities, sources of income, or real property which the Designated Employee must disclose for each disclosure category to which he or she is assigned. Category 1 - All Business Entities Doing Business in the City: All inyestments and business positions in, and sources of income from, all business entities that do business or own real property within jurisdiction of the City, plan to do business or own real property within the jurisdiction of the City within the next year, or haye done business or owned real property within the jurisdiction of the City within the past two years. Category 2 - Real Property: All interest in real property which is located in whole or in part within, or not more than two (2) miles outside, the boundaries of the City. Category 3 - Regulated Business: All inyestments and business positions in, and sources of income from, business entities subject to the regulatory, permit, or licensing authority of the Designated Employee's Department, will be subject to such authority within the next year, or haye been subject to such authority within the past two years. Category 4 - Construction and Real Estate: All inyestments and business positions in, and sources of income from, business entities that are engaged in land deyelopment, construction or the acquisition or sale of real property within the jurisdiction of the City, plan to engage in such actiyities within the jurisdiction of the City within the next year, or haye engaged in such actiyities within the jurisdiction ofthe City within the past two years. CatelWry 5 - Financial Institutions: All inyestments and business positions in, and sources of income from, business entities that are banking, sayings and loan, or other financial institutions.
