HomeMy WebLinkAbout5617 RESOLUTION NO. 5617 A RESOLUTION OF TIlE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DETERMINING THAT BILLIARD CLUBS ARE NOT A COMPATIBLE USE IN THE COMMERCIAL PLANNED DEVELOPMENT (CPD-I) ZONE. WHEREAS, the proceedings that are the subject of this Resolution are authorized by Arcadia Municipal Code Section 9260.1.12.(14); and WHEREAS, on June 4, 1991, the City Council considered a request submitted by Jerry Jamgotchian that billiard clubs be determined a compatible use in the Commercial Planned Development (CPD-l) zone, and, determined that a billiard club, subject to an approved Conditional Use Permit (CUP), could be a compatible use in the CPD-l; and WHEREAS, on July 9, 1991, the Planning Commission held a noticed public hearing and considered and denied a Conditional Use Permit application (CUP 91- 008) submitted by Pool Pockets, Inc. for a billiard club at 320-326 East Huntington Drive; and WHEREAS, the applicant appealed the Planning Commission's decision to the City Council; and WHEREAS, on August 20, 1991, the City Council held a noticed public hearing and considered and denied the applicant's appeal and CUP application; and WHEREAS, on the basis of the testimony presented at the August 20, 1991 appeal hearing, the City Council decided to reconsider the compatibility of billiard clubs in the CPD-l zone; and WHEREAS, on September 3, 1991, the City Council reconsidered the compatibility of billiard clubs in the CPD-l zone, and as part of the record, reviewed and considered the following: a. A verbal and written presentation of the City Council staff report. b. The reports, records and exhibits of the various hearings held in consideration of the CUP application (CUP 91-008) for a billiard club at 320-326 East Huntington Drive. c. A verbal and written presentation by Charles F. Baldini, a prospective billiard club applicant. 5617 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND AND RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Arcadia determines that billiard clubs are not a compatible use in the CPD-1 zone based on the following legislative findings: a. When the CPD-1 regulations were adopted in 1981, they were intended to encourage and supplement business and professional office uses, financial institutions, and service oriented businesses. b. Billiard clubs are the first entertainment oriented use to be considered by the City Council for inclusion as a compatible use in the CPD-1 zone. c. Business owners and their employees testified at the July 9, 1991 Planning Commission hearing, and at the August 20, 1991 City Council hearing that a billiard club would be detrimental to their businesses. d. Citizens from throughout the community testified at the July 9, 1991 Planning Commission hearing, and at the August 20, 1991 City Council hearing that billiard clubs are a use that would not complement the residential and professional business character of the City of Arcadia. SECTION 2. The decision and findings contained in this Resolution reflect the Council's legislative direction of September 3, 1991 by the following vote: A YES: Councilmembers Ciraulo, Fasching, Harbicht, Young and Gilb NOES: None ABSENT: None SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
