A RESOLUTION OF THE CITY COUNCIL OF THE CIT OF ARCADIA, CALIFORNIA, EXPRESSING CONCERN RE ARDING THE CITY OF SIERRA MADRE'S OPPOSITION TO HE IMPROVEMENT OF ORANGE GROVE AVENUE AND 0 FERING TO THE CITY OF SIERRA MADRE THE REALIGNME OF THE CITY BOUNDARY TO THE SOUTH SIDE OF 0 GE GROVE AVENUE WHEREAS, Orange Grove Avenue is a publi roadway, portions of which lie within the jurisdictional limits of the City of Arcadia and the City of Sierra Madre; and WHEREAS, the Orange Grove Avenue provement Project is in the general interest of the city of A adia and the City of Sierra WHEREAS, Avenue Improvement Project is of Madre: and WHEREAS, benefit to the motoring p and necessary to increase safety; and s udies and roadway design alternatives have of Arcadia and the City of Sierra Madre; and 20, 1991 the Arcadia City Council approved approving the roadway design concept for the improvement 0 ange Grove Avenue; and action and the aforementioned feasibility studies wer preceded by a long history in excess of fifteen (15) years of and study with regard to improvements of Orange ove Avenue; and the adoption of Resolution No. 5614 by the City of took place after numerous meetings and review by re resentatives of the City of Arcadia and the City of Sierra /o/tY9/ c::Jo/ CJ ." Madre; and WHEREAS, it was the City of Arcadia's understanding that its approval of the roadway design concept would be followed up by approval action from the City of Sierra Madre; and WHEREAS, on August 27, 1991 the city Council of the City Sierra Madre failed to approve Resolution No. 91-51 with regard to the approval of the design concept for the improvement of Orange Grove Avenue; and WHEREAS, Orange Grove Avenue is in need of improvements that are necessary to enhance its safety and in its current condition is subject to allegations of liability and potential exposure to liability claims; and WHEREAS, reasonable attempts to meet these safety concerns and improve Orange Grove Avenue have been thwarted and frustrated by the current stance of the City of Sierra Madre which is counter- productive to qood government, while according undue power and control to a vocal minority. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: SECTION 1. That the public safety and convenience require the completion of the Orange Grove Avenue Improvement Project. SECTION 2. To offer the City of Sierra Madre the City of Arcadia's portion of Orange Grove Avenue for purposes of a boundary realignment and request that Sierra Madre immediately take the proper steps to achieve this boundary adjustment. SECTION 3. Direct the City Clerk to forward this Resolution to the City Council of the City of Sierra Madre and the city 5619 , . Administrator and Director of Public Works for said city. SECTION 4. Direct the City Attorney of the City of Arcadia to report on viable legal options available for a course of action to take should the City of Sierra Madre reject the City of Arcadia's offer. SECTION 5. That city Clerk shall certify to the adoption of this Resolution. Passed, approved and adopted this day of , 1991.
