HomeMy WebLinkAbout5630 RESOLUTION NO. 5630 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 13 WHEREAS, the City Council of the City of Arcadia, at its regular meeting of October 22, 1991, called for a public hearing on November 19, 1991, at the hour of 7:30 o'clock p.m., in the City Council Chambers at the City Hall, Arcadia, california, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City described as follows: That portion of A Part of Arcadia Santa Anita Tract, as shown on map recorded in Book 15, Pages 89 and 90 of Miscellaneous Records in the office of the Recorder ofj Los Angeles County, bounded as follows: On the north by the prolongation of centerline of La Porte; on the east by the easterly right-of-way line of Second Avenue as same existed in July 1991, on the south by the northerly right-of-way line of Huntington Drive; on the west by the westerly line of Second Avenue as same existed in July 1991. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment - 1 - 5630 roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, THE COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That pursuant to Ordinance No. 1375 of the City of Arcadia, the above-described area is hereby declared an underground utility district and is designated as Underground Utility District No. 13 of the City of Arcadia. SECTION 2. That the City Council does hereby fix June 1, 1993, as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication of similar or associated service with Underground Utility District No. 13 on or before June 1, 1993. SECTION 3. That the City Council of the City of Arcadia hereby finds and determines the following exception in the said underground utility district No. 13: Overhead wires and supporting structures presently locate,d within the boundaries of said underground utility district No. 13 and used solely for transmission of 66KV power need not be removed. SECTION 4. That the City Council of the City of Arcadia hereby finds and determines that the Public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of - 2 - 5630 wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication of similar or associated service in said area. SECTION 5. That said city council finds and determines: 1. That the undergrounding to be accomplished pursuant to this resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. 2. The streets, road or right-of-ways in said area are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. SECTION 6. That the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 7. That the city Clerk shall certify to the adoption of this Resolution.
