HomeMy WebLinkAbout5638 RESOLUTION NO. 5638 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, RESCINDING PHASE II AND CONTINUING PHASE I OF THE MANDATORY WATER CONSERVATION PLAN PURSUANT TO ORDINANCE NO. 1930 AND RESTORING THE lOt VOLUNTARY WATER CONSERVATION GOAL PURSUANT TO RESOLUTION NO. 5435 WHEREAS, the City of Arcadia along with other communi ties throughout the State of California has experienced a fifth year of drought conditions and a reduction in water supplies continues; and WHEREAS, the City of Arcadia has adopted Ordinance No. 1930 establishing a mandatory Water Conservation Plan; and WHEREAS, section 7553.8 of this Ordinance provides that the City Council may by Resolution implement the various phases of this Plan; and WHEREAS, pursuant to Resolution No. 5568 Phases I and II of said Water Conservation Plan have been in effect since February 5, 1991; and WHEREAS, since that time the City has had the opportunity to conserve water, and administer and monitor said Plan; and WHEREAS, pursuant to Phase II of this Plan requiring a Mandatory 10% water conservation, the City of Arcadia conserved l2% more than what was required; and WHEREAS, the City Council has requested staff to modify the Plan to permit carry-over credits for water customers; and WHEREAS, Phase II is being rescinded until a modified Plan is implemented; and WHEREAS, Arcadia Municipal Code section 7553.8 requires that the appropriate phase of the Water Conservation Plan be implemented, modified or rescinded by Resolution. 5638 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION l. Phase II of the Plan is hereby rescinded on all bills mailed to water customers after December 3, 1991. SECTION 2. The lO% Voluntary Water Conservation Goal set forth in Resolution No. 5435 is restored. The lO% voluntary reduction is based on the 3-year averaging method utilized in the Mandatory Conservation Plan under authority of Ordinance No. 1930. SECTION 3. Phase I, Prohibited Uses Applicable to All Customers is continued in effect, and all provisions of section 7553.7.1 of Ordinance No. 1930 apply. SECTION 4. It is acknowledged and affirmed that the drought conditions continue, and that the passage of this Resolution does not preclude the City from reinstating additional phases to the Water Conservation Plan as authorized by Ordinance No. 1930, should the need arise. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
