RESOLUTION NO. 5750
A RESOLUTION OF THE CITY COUNCIL OF ARCADIA,
CALIFORNIA, DESIGNATING THE ARCADIA BEAUTIFUL
COMMISSION AS THE ARCADIA TREE COMMISSION FOR
PURPOSES OF THIS RESOLUTION AND ESTABLISHING A
COMPREHENSIVE CITY-OWNED TREE MANAGEMENT
PROGRAM
WHEREAS,
the city council has adopted an ordinance
establishing the Arcadia Beautiful Commission; and
WHEREAS, the City council wishes to create an Arcadia Tree
Commission to act on matters pertaining to the development and
administration of a comprehensive City-owned
tree management
program;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
HEREBY DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1.
It is the purpose of this Resolution to promote
and protect the public health, safety, and general welfare by
providing for the regulation of the planting, maintenance, removal,
and replacement of City-owned trees in street rights-of-way, City
parks and City property.
SECTION 2. This Resolution designates the Arcadia Beautiful
commission as the Arcadia Tree Commission for purposes of this
Resolution.
SECTION 3.
The Arcadia Tree Commission shall oversee the
preparation of, the reviewing of, and the recommendation of an
annual City-owned tree inventory, master plan, and work plan/budget
to the City Council for implementation;

SECTION 4. It is city policy to allow removal of City-owned
trees within street rights-of-way, City parks and City property,
only w~en they are dead, diseased beyond recovery, present a safety
problem, or cause extensive sewer problems due to tree root
intrusion.
Exceptions to the pOlicy may be considered and
determined by the Arcadia Tree Commission.
SECTION 5. The Arcadia Tree Commission may cause or order to
be removed, any City-owned tree or part thereof (in street right-
of-way, city parks and city property) which is dead, diseased
beyond recovery, presents a safety problem, causes extensive sewer
problems due to tree root intrusion, or is an exception to the City
policy of the previous section as determined by the Arcadia Tree
Commission.
SECTION 6. The Arcadia Public Works Department shall have the
right to plant, prune, maintain and remove City-owned trees within
the lines of all streets, alleys, avenues, lanes, and public
grounds, in accordance with this resolution.
SECTION 7. In new developments, the city Public Works
Department will review plans and may require street trees to be
planted in the affected streets in accordance with this Resolution.
SECTION 8. In accordance with the Arcadia Municipal Code, no
person may engage in the business of planting, cutting, trimming,
pruning, removing, spraying or otherwise treating City-owned trees
in street rights-of-way, city parks and City property without first
obtaining a permit and a business license.
SECTION 9. In accordance with the Arcadia Municipal Code, no
person shall plant, remove, cut above the ground, or disturb any
City-owned tree on any street, City park, or other City property

without first obtaining a permit from the Arcadia Public Works
Department.
The person receiving the permit shall abide by the
standards set forth in this Resolution and all applicable sections
of the Arcadia Municipal Code.
SECTrON 10.
In accordance with the Arcadia Municipal Code,
before any permit or business license shall be issued, each
applicant shall first file evidence of possession of workers
compensation and liability insurance, naming the City of Arcadia as
additional insured, in the minimum amounts of $l,OOO,OOO for bodily
injury or death and $500,000 property damage indemnifying the City
or any person injured or damaged resulting from the pursuit of such
endeavor as herein described.
SECTrON 11.
The following list constitutes the official
street Tree species for the city of Arcadia. No species other than
those included in this list may be planted as street Trees without
Small Trees
Medium Trees
written permission of the Arcadia Tree Commission:

Camphor
Carrot Wood
Holly Oak
Modesto Ash
Southern Magnolia
Queen Palm
Larae Trees
American Sweetgum
California Live Oak
canary Island pine
Canyon Live Oak
Cork Oak
Deodar Ceder
Elderman Oak
Southern Live Oak
Sycamore
White Alder
SECTrON 12. The spacing of Street Trees will be in accordance
with the three species size classes listed herein, and no trees may
be planted closer than the following: Small Trees, 30 feet; Medium
Trees, 40 feet; and Large Trees, 50 feet; except in special
plantings as approved by the Arcadia Tree Commission.

SECTION 13. No street Trees shall be planted closer than 35
feet from any street corner, measured from the end of the curb
return.
SECTION 14. No street Tree shall be planted closer than 10
feet from a fire hydrant.
SECTION 15. No street trees other than those species listed
herein as Small Trees may be planted under or within 10 lateral
feet of any overhead utility wire, or over or within 5 lateral feet
of any underground water line, sewer line, transmission line or
other utility.
SECTION 16. No street trees may be planted closer to any curb
or sidewalk than the following: small trees, 2 feet; medium trees,
3 feet; and large trees, 4 feet.
SECTION 17. All stumps of street trees, City park trees and
trees on City property shall be removed one (1) foot below the
surface of the ground.
SECTION 18. No person, firm, or City department may top any
street tree, City park tree, or other tree on public property.
Topping is defined as the severe cutting back of limbs within the
tree's crown to such a degree so as to remove the normal canopy and
disfigure the tree. Trees severely damaged by storms or other
causes, or certain trees under utility wires or other obstructions
where other pruning practices are impractical may be exempted from
this requirement as recommended by the Arcadia Public Works
Department and approved by the Arcadia Tree commission.

SECTION 19. The City Council shall have the right to review
the decisions of the Arcadia Tree commission.
Any person may
appeal any rule or order of the Arcadia Tree commission to the city
council who may hear the matter and make final decision.
SECTION 20. The City Clerk shall certify to the adoption of
this Resolution. Passed, approved and adopted this 2nd day of November
1993.
