RESOLUTION NO. 5762
A RESOLUTION OF THE CITY OF ARCADIA, CALIFORNIA,
SETTING SERVICE RATES FOR THE COMMERCIAL AND
INDUSTRIAL RECYCLING PROGRAM WITHIN THE CITY
OF ARCADIA
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY
DETERMINE, FIND AND RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Arcadia Municipal Code Section 5130 (a), the Arcadia City
Council is authorized to fix and determine the uniform rates that may by charged for the
collecting, or removing of garbage or refuse from any premises in the City.
SECTION 2. That all commercial, retail and manufacturing businesses in the City are
required to purchase a minimum level of recycling and green waste service from the Contractor,
unless they can prove to the City and the Contractor that all of the materials deemed recyclable
by the Commercial and Industrial Recycling Agreement are being diverted from the refuse
stream by other means. A minimum level of recycling service shall mean the collection of
recyclable materials at least once per week in a single 96-gallon container. A minimum level
of green waste service shall mean the collection of green waste at least once per week in a 33
gallon container.
SECTION 3. That the Contractor shall not charge or collect any fees or rates other than
the fees and rates for the commercial and industrial recycling rates set forth in this Resolution
and that the fees and rates shall remain in effect, unless changed by a Resolution of the City
Council of the City of Arcadia.

SECTION 4. That the fee for the commercial and industrial recycling program shall be:

SECTION 5. That effective May 1, 1994, the fees for the commercial and industrial
recycling program for the collection of recyclable materials shall become effective.
SECTION 6. That the City Clerk shall certify to the adoption of this Ordinance and shall
cause a copy of the same to be published in the official newspaper of the City within fifteen (15)
days upon its adoption.
