A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, APPROVING CONDmONAL USE PERMIT 89-015 A
PROPOSED RESTAURANT AT 430 EAST HUNTINGTON DRIVE
(ARCADIA GATEWAY CENTRE) WITH CONDmONS AND
FINDINGS
WHEREAS, on September 1, 1989, an application was filed by Arcadia
Gateway Centre Associates to construct a 9,200 square foot restaurant, Planning
Department Case No. c.u.P. 89-015 on property located at 430 East Huntington
Drive, more particularly described in attached Exhibit A.
WHEREAS, a public hearing was held before the Planning Commission on
September 26, 1989; and
WHEREAS, after a public hearing the Planning Commission voted 3-0 with
one member abstaining and one member absent to approve Conditional Use Permit
89-015 and adopted Planning Commission Resolution 1422 reflecting their decision;
and
WHEREAS, on October 3,1989, Council Member Lojeski appealed the
Planning Commission's approval in order to allow the City Council the opportunity
to review the proposed project; and
WHEREAS, on November 7, 1989 the City Council heard the appeal; and
WHEREAS, as part of the record of this hearing the City Council reviewed
and considered:
a. All staff reports and related attachments and exhibits submitted by the
Planning Department to the Planning Commission and City Council.
b, The record of the Planning Commission hearing regarding C.U.P. 89-015.
c. All oral presentations and testimony made during the public hearing on
November 7, 1989.
WHEREAS, after deliberation the City Council voted 5-0 to approve and file a
Negative Declaration finding that the project will not have a significant effect on the
environment and to approve Conditional Use Permit 89-015 subject to the
conditions set forth below and directed preparation of this Resolution to formally
reflect that decision and findings.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:

Section 1" This Council finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to tile property or improvements in
such zone or vicinity.
2. That the use applied for at tile location indicated is properly one for which
a Conditional Use Permit is authorized.
3. The proposed use would result in a net deficiency of approximately 20
spaces. The applicant presented a plan whereby they could reduce the number of
deficient spaces to eight. This would be accomplished by reducing the size of tile
compact spaces adjacent to and around the restaurant from 8'-6" to 8'-0" and by
replacing one row of standard parking spaces with 8'-0" compact spaces, thus
increasing the number of compact spaces to 30% in lieu of the 25% granted by
modification. It was the consensus of the Council that they would prefer to see tile
parking layout as it exist rather tilan reducing tile size of tile existing compact spaces
and increasing the percentage of compact spaces. The Council felt that the parking
reduction would not have a significant impact on the site.
4. That tile site abuts streets and highways adequate in widtil and pavement
type to carry the kind of traffic generated by an eating establishment.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan,
6, That tile use applied for will not have a substantial adverse impact on the
environment.
Section 2, That for the foregoing reasons this Commission approves a
Conditional Use Permit to construct a 9,200 sq. ft. restaurant upon the following
conditions:
1. That the gross floor area ofthe restaurant shall not exceed 9,200 sq. ft.
2. That the 7,208 sq. ft. of office uses which are proposed to be located within
the retail building (300 East Huntington Drive), shall not be converted at a later
date to retail or other uses which have a greater parking requirement.
3. That Resolution No. 1397, approving Conditional Use Permit 88-028, is
amended to allow a maximum of two eating establishments located within the
retail building (300 East Huntington Drive), and that the seating within each
establishment shall not exceed 12 persons.
4. That the architectural design review of the proposed restaurant shall be
subject to the review and approval of the Arcadia Redevelopment Agency.

5. That Cu.P. 89-015 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
6, Noncompliance with the provisions and conditions of this Conditional
Use permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
Section 3, The City Clerk shall certify to the adoption of this Resolution.
