RESOLUTION 5548 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING AN APPEAL FOR THE APPROVAL OF CONDmONAL USE PERMIT 90-010 WHICH PROPOSES A 40-LOT RESIDENTIAL PLANNED DEVELOPMENT AT 702-822 NORTH FIRST AVENUE AND 105-119 HAVEN AVENUE, WHEREAS, on June 25, 1990, an application was filed by John E. Plount for a proposed 40-lot residential planned development, Planning Department Case No, c.u.p, 90-010, on property located at 702-822 North First Avenue and 105-119 Haven Avenue, more particularly described as follows: Portions of Lots 6 and 9, Block 89, Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 41, Page 42 of Miscellaneous records in the office of said County Recorder, WHEREAS, a public hearing was held before the Planning Commission on July 24, 1990; and WHEREAS, after a public hearing the Planning Commission moved to approve C.U,P. 90-010 and voted 2-2 with one member absent, The motion failed due to the tie vote; furthermore the absent commissioner had a conflict of interest and therefore was not able to cast the deciding vote at the subsequent commission meeting; and WHEREAS, on July 27,1990, the applicant appealed the matter to the City council in order to receive approval of c.u.p, 90-010; and WHEREAS, on August 21, 1990, the City Council heard the appeal; and WHEREAS, as part of the record of this hearing the City Council reviewed and considered: a, All staff reports and related attachments and exhibits submitted by the Planning Department to the Planning Commission and City Council. b. The record of the Planning Commission hearing regarding c.u.p, 90-010. c, All oral presentations and testimony made during the public hearing on August 21, 1990, WHEREAS, after deliberation the City Council voted 4-0 with one member absent to approve and file a Negative Declaration finding that the project will not have a significant effect on the environment and finding that the design concept 1 5548 plans are in compliance with the ADR criteria and to approve Conditional Use Permit 90-010 subject to the conditions set forth below and directed preparation of this Resolution to formally reflect that decision and findings, NOW, lHEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. This Council finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity, 2, That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized, 3, That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5, That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, 6, That the use applied for will not have a substantial adverse impact on the environment, Section 2, That for the foregoing reasons this Council grants a Conditional Use Permit for the proposed 40-lot residential planned develop upon th~ following ro~~M: ' 1. Conditions of approval from the Public Works Department, as set forth in attached Exhibit "A", shall be complied with to the satisfaction of the Director of Public Works in accordance with the applicable provisions of the Arcadia Municipal Code. 2. Water Department requirements, as set forth in attached Exhibit "B", shall be complied with to the satisfaction of the Water Manager, 3, Water requirements for fire protection shall be determined by the Arcadia Fire Department. 4. All dwellings shall have automatic fire sprinkler systems per N,F,P,A. standard 13R. 5. Two on-site hydrants of a minimum capacity of 1500 gpm shall be provided, The hydrants shall be placed in appropriate locations which meet the 2 5548 . requirements of the Arcadia Fire Department and Water Department, and shall be functional prior to any framing, 6, The private streets shall be designed to support a minimum of 55,000 pounds on an all weather surface and shall be completed prior to any framing, 7, All perimeter and garden walls shall be of decorative block or finished with stucco, subject to the review and approval of the Planning Department. 8, That a tree preservation plan identifying by size and type all trees with a diameter in excess of 6" shall be presented to the Planning Department for its review and approval prior to the issuance of a grading permit, 9. That the following modifications be granted for this project: A, To permit the following building setbacks in lieu of the requirement that no building shall be constructed within 25'-0" of the perimeter property line of the development (Sec, 9277,14,): 1, 10'-0" to 20'-0" setbacks along the site's northerly and easterly property lines; and 2. 6'-0" to 8'-0" setbacks along the perimeter sides of an interior lot which is not a part of the proposed development, 8, To permit 2'-0" + window projections within a proposed 25'-0" building setback in lieu of a special setback of 35'-0" along Haven Avenue (Sec, 9320,36,1.) 10, Any garage opening directly upon a street shall be located not less than eighteen (18) feet from the front or side street lot line, 11. That the access way leading to the riding and hiking trail shall have a self-locking and closing security gate to prevent unauthorized access from the trail area, 12, That the perimeter masonry block wall along the east side of the site, which is adjacent to the riding and hiking trail, shall be 8'-0" in height and subject to the review and approval of the Planning Department. 13. There shall be a solid, 6'-0" high, decorative block wall constructed between the proposed swimming pool area and the neighboring lots (Le., lot nos, 36 and 39) to mitigate the potential noise problem, Said wall shall be subject to the review and approval of the Planning Department. 14, The architectural design of the proposed recreation building and gazebo shall be visually harmonious with the surrounding structures on the site, and subject to the review and approval of the Planning Department. 3 5548 . 15, That the common recreation/leisure areas shall be completed prior to the occupancy of any of the dwelling units, 16, That after the issuance of a building permit a Rough Grading Certificate will be required prior to the placing of any concrete on the site; and a Final Grading Certificate shall be required prior to the final building inspection. Said certificates will certify that all finished grading operations have been completed in substantial compliance with the final grading plan approved by the City Engineer, and shall be filed with, and approved by, the Planning Department. 17, That covenants, conditions and restrictions containing provisions for property maintenance shall be submitted for review and must be approved in writing by the Planning Department and the City Attorney, prior to the final building inspection, 18, Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. 19. That C.U,P. 90-010 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 20, That the total number of bedrooms within the development shall not exceed an average of 4.25 per dwelling unit. 21. That the existing trees within the 25'-0" setback along First Avenue shall be maintained, where feasible, as determined by the Planning Department. 4 5548 . July 12, 1990 TO: PLANNING DEPARTMENT FROM: PUBLIC WORKS DEPARTMENT SUBJECT: CUP 90-010, 702-822 N, First Avenue and 105-119 Haven Avenue, 40 Lot Residential Planned Development In response to your memorandum, the items which this department has concern or special knowledge of are listed below: 1. The existing parkway width is twelve (12) feet on both First and Haven Avenues. 2. Public streets shall have a sixty (50) foot right-of-way or a fifty (50) foot right-of-way and a five (5) foot planting and sidewalk easement on each side and a minimum of thirty-six (35) feet from curb to curb. 3. The subject property is served by a sewer line that has the capacity to transport sewage flows generated in accordance with land use reflected in the City's current general plan to CSD's system. 4. Traffic volume will be increased, but there will ~~ no major impact. This department has reviewed the subject CUP and recommends the following conditions of approval: 1. Submit grading and drainage pl an Prepared by a reg.i,stered civil engineer subject to the approval of the Director of Public Works. Provide calculations for gravity drainage system. Computations should show hydrology, hydraulics and elevations. NOTE: Show all existing and proposed parkway trees, pull boxes, meters, power poles, street lights, driveways, sidewalks and handicap ramps on grading/drainage plan. 2. The Declaration of covenants, conditions, restrictions and reservations as well as the Final Tract Map shall have a clause stating the owners or an association representing the owners of the development will own and maintain streets, sidewalks and all private utility structures within the said development. The Declaration shall be subject to review and approval of the Director of Public Works prior to recordation of the final map. 3. All private streets shall have a minimum of forty five (4S) foot wide utility easement dedicated to the City, 4. Construct curb, gutter, paving and sidewalk necessary to complete a knuckl e-type curve northeast u f Lor~,la Avenue and Haven Avenue intersection. Dedicate sufficient land. for a continuous twelve (12) foot parkway adjoining said curve. 5. Construct a twenty-five (2S) foot curb return and dedicate a fifteen (IS) foot corner cut-off for street purposes at the northeast corner of First Avenue and Haven Avenue. Plant twenty-one (21) parkway trees along First and Haven Avenues at locations determined by the Director of Publ ic Works per Arcadia City Standard Drawing S-13-1. 7. Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match existing. 8. Design and construct minimum 8 inches sewer main and 6 inches lateral on private streets subject to approval of the Director of Public Works. 9. Construct five (5) foot P.C.C. sidewalk adjacent to curb along Haven Avenue as per Arcadia City Standard S-17. 10. Remove and replace deficient or damaged curb, gutter, sidewalk and/or pavement to the satisfaction of the City Engineer. Contact Public Works Department for exact locations of removal and replacement. 11. Obtain approval from the Department of Public Works prior to removal of any portion of the existing gutter on First and Haven Avenues. 12. Construct P.C.C. cross gutter on First and Haven Avenues per Arcadia City Standard Drawing S-12. 13. Construct P.C.C. residential driveway aprons along First and Haven Avenues as per City of Arcadia Standard Drawing No. S-11. 14. Construct handicapped ramps at driveway entrances to private streets along First and Haven Avenues and at the northeast corner of First and Haven Avenues per Arcadia City Standard. 15. Obtain connection permit from the Los Angeles County Public Works Department (LACFC Division) to drain storm runoff into Santa Anita Wash. A copy of the permit must be submitted to the Arcadia Publ ic Works Department prior to construction. 16. Arrange for underground utility service and dedicate easements to utility companies. 17. Construct all curb returns with a minimum of a twenty-five (25) foot radius. 18. Private streets shall have a minimum four (4) foot wide P. C. C. sidewalk adjacent to the curb. 19. Repair riding and hiking trail damaged due to construction to the satisfaction of the L.A. Install City approved standard street name signs and one (I) stop sign at each main driveway exits on private streets at intersection with Haven and First Avenues. 21. Private streets shall have full (vertical) height P.C.C. curb with eighteen (I8) inch P.C.C. gutter to match existing per City Standard S-II. 22. Sidewa 1 k areas on pri vate streets sha 11 be unobstructed by any ut il ity structures. 23. Paint house numbers on curb face per Arcadia City Standards. 24. Arrange with the Edison Company to install one (1) standard City-owned street light on Haven Avenue, replace existing street lights with two (2) new standard City-owned street lights on First Avenue and install nine (9) street lights on private streets with underground circuits. Location is subject to approval of the Director of Public Works. Also, arrange for the removal of street light on wood pole at southwest corner of Lorena and Haven Avenues. Contractor shall obtain an approved plan from the City's Engineering Division. Street lights on private streets shall be installed behind the sidewalk. 25. Submit street, sewer, storm drain, and street 1 ight improvement plans prepared by a registered civil engineer subject to for approval of the Public Works Director. 26. All public works improvements shall be completed to the satisfaction of Director of Public Works prior to final acceptance by Building and Safety Department and prior to occupancy. 27. New' centerl i ne ties set as part of thi s subdi vi s i on must be submi tted before final acceptance of project. 28. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed.
