HomeMy WebLinkAbout5719 RESOLUTION NO. 5719 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CONSENTING TO ESTABLISHMENT OF THE PORTIONS OF LAS TUNAS DRIVE WITHIN SAID CITY AS PART OF THE SYSTEM OF HIGHWAY OF THE COUNTY OF LOS ANGELES WHEREAS, the Board of Supervisors did on February 9, 1993 duly adopt a Resolution declaring the portions of the streets listed below, within the Cities of Alhambra, Arcadia, Claremont, LaVerne, Pomona, San Gabriel and Temple City, to be a part of the System of Highways of the County of Los Angeles, as provided in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of California; and Name of Street Limits Main Street Las Tunas Drive Arrow Highway Huntington Drive to Las Tunas Drive Main Street to Live Oak Avenue Wheeler Avenue to Mills Avenue WHEREAS, said Board of Supervisors by said Resolution requested this Council to give its consent to allow the County to synchronize traffic signals and perform appurtenant work within said portions of Las Tunas Drive in the City of Arcadia described above; and WHEREAS, pursuant to Section 15301, Class I (c), of the State Guidelines for Implementation of the Cal ifornia Environmental Qual ity Act of 1970, the Secretary of Resources designated this type of project as categorically exempt, NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: I 5719 SECTION 1. Consent to Inclusion in County Hiqhway System. This City Council does hereby consent to the establishment of those portions of Las Tunas Drive from the west City limit to Live Oak Avenue, within the City of Arcadia, as part of the System of Highways of the County of Los Angeles as provided in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of Cal ifornia. Said consent is for the purpose of synchronizing traffic signal sand performing appurtenant work as may be necessary by the County of Los Angeles. SECTION 2. Coooeration with Neiqhborinq Jurisdictions. This City Council does hereby consent to cooperate with neighboring jurisdictions to implement coordinated traffic signal control across jurisdictional boundaries, SECTION 3. Maintenance and Ooeration. This City Council does hereby consent to maintain and operate and to finance its jurisdictional share of the maintenance and operation costs of the improvements installed with this project at intersections not covered by existing Signal Maintenance Agreement No. 41096 between the City of Arcadia and the County of Los Angeles, executed on February 23, 1982. In order to maintain full effectiveness of these improvements, any change in signal timing for any of the intersections within the project limits within the jurisdictional boundaries of the City of Arcadia shall only be done upon mutual agreement between the City of Arcadia and the County of Los Angeles. SECTION 4. Indemnification. This City Council does hereby consent to defend, indemnify and hold harmless the County of Los Angeles and its officers and employees from any liability imposed for injury occurring by reason of any acts or omissions on the part of the City of Arcadia under or in connection with any work performed with this project. 2 5719 SECTION 5. Findina of Cateaorical Exemption. This City Council does hereby find that the project is categorically exempt from the requirement for an Environmental Impact Report pursuant to Section 15301, Class 1 (c), of the State Guidelines for Implementation of the California Environmental Quality Act of 1970. SECTION 6, Findina of a Minor Nature. This City Council does hereby find that pursuant to Government Code, Section 65402 (b), the aforesaid street improvements are of a minor nature and that, therefore, the provisions of said Section requiring the submission to and report upon said project by the City Planning Agency do not apply. SECTION 7. That the City Clerk shall certify to the adoption of this Resolution and that a copy of this Resolution be forwarded to the County Board of Supervisors, System of Highways, Passed, approved and adopted this April ATTEST: ia 3 5719 STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES ) SS: CITY OF ARCADIA ) I, JUNE D.
