HomeMy WebLinkAbout5316 RESOLUTION NO. 5316 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID COUNTY A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS AND DRAINAGE SYSTEM KNOWN AS MISCELLANEOUS TRANSFER DRAIN NO. 1097 UNIT I AND UNIT II, IN THE CITY OF ARCADIA FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZING THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated to, or the City of Arcadia has otherwise acquired, the storm drain improvements and drainage system known as Miscellaneous Transfer Drain No. 1097 Units I and II, described in Exhibit A, attached hereto; and WHEREAS, the City of Arcadia is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an Agreement dated February 2, 19B2, and recorded on March B, 1982, as Document Number 82-247850, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit A attached hereto from the City of Arcadia to the Los Angeles County Flood Control District for future operation, maintenance, repair and improvement. -1- 5316 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOllOWS: SECTION 1. That the City of Arcadia by and through its City Council does hereby request that the Los Angeles County Flood Control District accept the transfer and conveyance of the storm drain improvements and drainage systems described in Exhibit A. SECTION 2. That, subject to the acceptance thereof by Resolution of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer of the City of Arcadia is directed and ordered to prepare a 11 necessary instruments and documents inc 1uding deed, to effectuate sa id transfer and conveyance and That the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements and drainage until all rights of way for said drain now vested in the City of Arcadia and all other necessary rights of way therefor have been conveyed to and accepted by Department. Reference is hereby made to District Drawings Nos. 364-1401-F6.1- 6.7, the plans and prOfile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said Department for further data as to the exact location, extent and description of said storm drain improvements and drainage system. SECTION 3. That the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated February 2, 1982, and recorded March 8, 1982, as -2- 5316 Document Number 82-247850, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated here by this reference. SECTION 4. That the City Clerk shall certify to the adoption of this Resolution. Passed, approved and adopted this 2nd day of September 1986. ZbaAf; ~'#U~r Mayor of e 1 y 0 rca la STATE OF CALIFORNIA COUNTY OF LOS ANGELES CITY OF ARCADIA I, CHRISTINE VAN MAANEN, City Clerk of the City of Arcadia, hereby certify that the foregoing Resolution No. 5316 was passed and adopted by the City Council of the City of Arcadia, signed by the Mayor and attested to by the City Clerk at a regular meeting of said Council held on the 2nd day of September , 1986, and that said Resolution was adopted by the following vote, to wit: AYES: Councilman Chandler, and Young , NOES: None ABSENT: Councilman -3- 5316 EXHIBIT "A" MISCELLANEOUS TRANSFER DRAIN NO. 1097 UNIT 1 Storm drain in westbound Huntington Drive A total of 1,296 feet more or less of 33" RCP (1,5000 and 2,000D) and appurtenances thereto extending from station 170 + 50.06 on the Arcadia Wash (West Branch) in a 15 foot easement parallel to the westerly property 1 ine of westbound Huntington Drive to a catch bas in approximately 80 feet north of the center line of Civic Center Place. MISCELLANEOUS TRANSFER DRAIN NO. 1097 UNIT 2 Storm drain in Lovell Avenue A total of 1232 feet more or less of 33" RCP (1,500D) and 101 feet more or less of 24" RCP (1750D) and appurtenances thereto extending from Station 43 + 35.54 on Line "A" Norman Avenue Project No. 1401 at the intersection of Norman Avenue and Lovell Avenue to a catch basin at the intersection of Naomi Avenue and Lovell Avenue.
