PLANNING COMMISSION GRANTING CONDITIONAL USE PERMIT 66-14 WITH FINDINGS WHEREAS, on Jenuery 20, 1967, the City Councll heerd the eppeel filed by Boller, Suttner & Peterson on behelf of the Sl1vergete Condominiums concerning Condi t i one I Use Permi t 66-14 to construct end operete e boerd end cere/retirement fecility et 607-611 West Duerte Roed, more perticulerly descrlbed es follows: lot 44, Tract 3430 in the City of Arcadie, County of los Angeles, Stete of Callfornie, es per Map recorded in Map Book 42, pege 32 in the County Recorder's Office WHEREAS, the City Council considered the previous proceedings of the Plenning Commission, exhibits and wrltten materiel presented for the heerings on November 12 end November 25 including City st8ff reports end testimony of witnesses all of which constitute the record of the hearlng, and WHEREAS, efter deliberation the City Council voted 4-0 with one member absent to deny the eppeel end sustein the approval of the Planning Commission and directed preperation of this resolution to formelly reflect their decision and findings, NOW, THEREFORE, THE CITV COUNCil OF THE CITV OF ARCADIA, CALIFORNIA, DOES HEREBV RESOLVE AS FOllOWS: SECTION 1. This Council finds: 1, That the granting of such Conditionel Use Permit will not be detrimental to the publiC health or welfare, or injurious to the property or improvements in such zone or vicinity because the proposed board and care facility is an appropriate use in the R-3 zone and based upon the findings cited below it is a less 5339 Intense use tnan a multI Ole famllu llevelooment. rne council notell tnllt faCIlitIes where seniors can l1ve in a safe and secure environment is desirable in this community. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized because of the reasons set forth in NO.1 and because conditions have been applied to mitigate potential problems and concerns pursuant to Section 2 below, 3, That the site for the proposed use is adeQuate in si ze and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features reQuired to adjust said use with the land and uses In the neighborhood, The Council noted that based upon studies submitted of existing facl1itles in other communities and the existing facl1itles in the City, that the 40 parking spaces are adeQuate to serve the facility, 4, That the site abuts streets and highways adeQuate in width and pavement type to carry the kind of traffic generated by the proposed use. It was determined that this type of use does not generate a large amount of traffic, Duarte Road is a major arterial and Arcadia Avenue has been recently widened to accommodate the traffic generated by the multiple-faml1y uses on the street. 5, That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, The General Plan designation is Multiple- Family (7+ du/ac), 6, That the use applied for wiIJ not have a substantial adverse impact on the environment. The Council determined that the proposed use would not have a significant effect on the environment and that the use would be less intense than a multiple-family use which is permitted in the R-3 zone without a conditional use permit. -2- 5339 SECTION 2. That for the foregoIng reasons thIs CouncIl grants a Conditional Use Permit to construct and operate a board and care retirement facility upon the fOllowing conditions: I. That the conditions listed below from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works, a, Submit gradIng and draInage plan prepared by a registered clvll engineer subject to the approval of the Director of PUblic Works, b, Plant parkway trees at locations determined by the DIrector of Public Works per Ci ty of ArcadIa Standard S-13, c. Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match exIstIng, d. Construct P.C,C, driveway apron according to ArcadIa Standard Drawing No. S-II. e. All survey monuments, centerline tIes end survey reference points shall be protected in place or re-established where dIsturbed, This work will be the responsibility of the permIttee and shall be at the permittee's expense. 2. That fIre safety shall be provIded to the satisfactIon of the Fire Chief. 3, That a modification be granted for 40 perking spaces, 4. That a modification be granted for e density of one unit per 622 square feet of lot area (maximum 103 units), 5. That the minimum age for residency in this faClllty shall be 60 years and that a covenant or other agreement as deemed appropriate by the City AHomey shall be flied guaranteeIng that the minimum age of residents shall be 60 years, 6, That the maximum height of the bulldlng shall be 35'-0. with the exception of the bell tower which may be 40'-0. if It serves as access to the roof area. -3- 5339 7. Said plans shall be submitted to the Planning Department for its review and approval. 9, That deliveries shall be restricted to the hours of 7 a.m. to 7 p,m" Mondays through Fridays, No deliveries shall be allowed on the weekends, 1 0, Thllt the maximum density shall not exceed an average of 1.5 residents per room with a total of 154 residents, No room shall have more than 2 occupants, The developer shall be required to provide a covenant or other agreement as deemed necessary by the City Attorney to implement this condition, 11. That the easterly driveway shall be restricted to ingress only and egress shall be from the westerly drlyeway. That the driveways shall be posted with "Right Tum " signs, 12. That the guest parking area Shllll be increased from 7 to 13 spaces, 13, That C,U,P. 86-14 shall not take effect until the owner and applicant hIIve executed a form ava11able at the Planning Department indicating awareness and acceptance of the conditions of approyal. 14. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute groundS for the immediate suspension or revocation of sai d Permi t. SECTION 3.
