RESOLUTION NO. 6008
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING AND ADOPTING
CERTAIN AMENDMENTS TO THE CONFLICT OF
INTEREST CODE PURSUANT TO THE PROVISIONS OF THE
POLITICAL REFORM ACT OF 1974, TITLE 9 OF THE
GOVERNMENT CODE
WHEREAS, the legislature of the State of California enacted the Political Reform Act of
1974, Government Code Section 8\000 et seq. (the "Act"), which contains provisions relating to
employees and consultants of the City of Arcadia (the "City") and which requires all public
agencies to adopt and promulgate a Conflicts of Interest Code; and
WHEREAS, the City has previously adopted its Conflicts ofInterest Code (the "Code")
in compliance with the Act; and
WHEREAS, the City has previously adopted an amended Code as made advisable and
necessary by amendments to and changes in the Act and the regulations of the Fair Political
Practices Commission (the "Regulations"), as well as changed circwnstances within the City,
occurring after the City adopted the Code; and
WHEREAS, further subsequent amendments to and changes in the Act and the
Regulations, as well as further changed circumstances within the City, have made it advisable
and necessary further to amend and update the Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. A new Section 540 is added to the Code, which provides and reads as
follows:
Section 540. Prohibition on Receipt of Honoraria. No designated employee shall

accept any honorarium from any source, if the employee would be required to
report the receipt of income or gifts from that source on his or her statement of
economic interests. Subdivisions (a), (b), and (c) of Government Code Section
89501 shall apply to the prohibitions in this section. This section shall not limit
or prohibit payments, advances, or reimbursements for travel and related lodging
and subsistence authorized by Government Code Section 89506.
SECTION 2. A new Section 570 is added to the Code, which provides and reads as
follows:
Section 570. Prohibition on ReceiDt of Gifts in Excess of$290. No designated
employee shall accept gifts with a total value of more that $290 in a calendar year
from any single source, if the employee would be required to report the receipt of
income or gifts from that source on his or her statement of economic interests.
Subdivisions (e), (f), and (g) of Government Code Section 89503 shall apply to
the prohibitions in this section.
SECTION 3. Section 600, subsection (a)(5) as it currently reads is hereby amended to
read as follows:
(5) Any donor of, or any intermediary or agent for a donor of, a gift or
gifts aggregating two hundred ninety dollars ($290) or more in value provided to,
received by, or promised to the designated employee within twelve (12) months
prior to the time when the decision is made.
SECTION 4. A new subsection (c) of Section 600 is added to the Code, which provides
and reads as foHows:

(c) Legallv Required Participation. No designated employee shall be
prevented from making or participating in the making of any decision to the
extent his or her participation is legally required for the decision to be made. The
fact that the vote of a designated employee who is on a voting body is needed to
break a tie does not make his or her participation legally required for purposes of
this section.
SECTION 5. Exhibit A of the Appendix to the Code is hereby amended in its entirety.
The new Exhibit A is attached hereto and incorporated by this reference.
SECTION 6. The City Clerk shall certify to the adoption of this Resolution.

1. The City Attorney, City Manager, Treasurer, and Planning Commissioners are
required to file a disclosure statement under Government Code section 87200 et seq. and do
not file as designated employees.
2. Consultants are included in the list of designated employees and shall disclose
pursuant to the broadest disclosure category in the Conflict of Interest Code subject to the
following limitation:
The City Manager may determine in writing that a particular consultant, although
a "designated position," is hired to perform a range of duties that are limited in scope and thus
is not required to fully comply with the disclosure requirements described in the Conflict of
Interest Code. Such written determination shall include a description of the consultant's duties
and, based upon the description, a statement of the extent of disclosure requirements. The
. City Manager's determination is a public record and shall be retained for public inspection in
the same location as is the Conflict of Interest Code.
