HomeMy WebLinkAbout6038 RESOLUTION NO. 6038 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA OPPOSING AB 252 AND SUPPORTING THE RETENTION OF LOCAL CONTROL OF LAND USE AND PLANNING DECISIONS WHEREAS, local control of land use and planning decisions is central to the proper functioning of cities and counties in considering proposed developments; and WHEREAS, in Arcadia, as in communities throughout the State, a major factor in selecting the location of residence is the quality of the schools in the community; and WHEREAS, court decisions have preserved the rights of school districts to seek the denial of a development project by a city or county if the schools will be adversely impacted and the developer has not adequately addressed the impact; and WHEREAS, all districts benefit from the protections that keep schools in the planning process; alnd WHEREAS, the Mira, Hart and Murrieta court cases have supported the rights of school districts to work through the local planning process and seek the denial of a proposed residential development if there is inadequate classroom space for the new students and inadequate funding to provide that space; and WHEREAS, it would be wrong to allow developers to successfully leverage State school bonds in trade for making the schools the only type of facilities that would be excluded from full planning and land use protections under law; and WHEREAS, it is City Councils, School Boards and/or County Boards of Supervisors, not developers, that parents, taxpayers and voters hold accountable for providing adequate facilities to meet the community's needs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The City Council opposes AB 252 and any legislation that would remove the ability of the City Council to consider the adequacy of schools when making planning decisions and supports the retention of local control over land use and planning decisions. SECTION 2.. , The City Clerk shall certify to the adoption of this Resolution.
