HomeMy WebLinkAbout6041 RESOLUTION NO. 6041 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA SUSTAINING THE PLANNING COMMISSION'S DENIAL OF TENTATIVE PARCEL MAP 98-002 (PARCEL MAP NO. 24947) AT 270 WEST ORANGE GROVE AVENUE WHEREAS, Tentative Parcel Map 98-002 (Parcel Map No. 24947) was filed on November 18, 1997 by Stryker Engineering on behalf of Rex Moore, request to subdivide two lots into three lots at 270 West Orange Grove Avenue, more particularly described as follows: A portion of Lot 1 of Tract 948, in Book 17, Page 21 of Maps and Lots 1 and 2 of Tract 10955,191/27-30 of Maps. Records of L. A. County. WHEREAS, a public hearing was held on January 12, 1998, before the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Planning Commission of the City of Arcadia voted 5-1 to deny said request; and WHEREAS, on January 14, 1998, per Section 9600 of the Arcadia Municipal Code the Mayor appealed the Planning Commission's denial; and WHEREAS, on February 3, 1998 the City Council conducted a public hearing concerning TPM 98-002, and considered all of the evidence presented including the staff report and other submitted written materials. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES HEREBY FIND AND DETERMINED AS FOLLOWS: Section 1. Decision. Based on the findings set forth in this Resolution, the appeal of the denial by the Planning Commission is not granted and Tentative Parcel Map 98-002 is denied. Section 2. Findings. a. The applicant proposed three lots that all front on Caballero Road. None of the proposed lots front on Orange Grove along the 300+ feet of Orange Grove frontage. The applicant stated at the hearing that he did not want to consider any subdivision that res'ulted in one or two of the lots fronting on Orange Grove. b. The neighborhood is characterized by large lots that front on both Orange Grove and the streets off of Orange Grove. From Oakmeadow Road to Santa Anita Avenue, there is a lot fronting on Orange Grove with a range of approximately 87 feet to 220 feet from each corner. The variety of lots facing both Orange Grove and the -1- 6041 various side streets enhance the compatibility and balance of the lots in the neighborood. c. The site is not physically suitable for the density of development based on the configuration of lots submitted by the applicant because all three of the proposed lots front on Caballero Road. This increases the concentration or density of Jots facing this side street and disrupts the balance of lots facing Orange Grove. d. The configuration of the proposed subdivision injuriously affects the neighborhood wherein the subject property is located because of its unreasonable impact on the compatibility and balance of lots in the neighborhood. This impact can be mitigated by a revised configuration that provides for one or two lots fronting on Orange Grove. Section 2. The City Clerk shall certify to the adoption of this Resolution.
