HomeMy WebLinkAbout4475 .' RESOLUTION NO. 4475 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA DECLARING ITS INTENTION TO VACATE DEARBORN STREET BETWEEN PECK ROAD AND MYRTLE AVENUE. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION l. That the City Council of the City of Arcadia pursuant to Chapters 1, 2 and 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, Section 8300, et seq., does hereby declare its intention to vacate and abandon Dearborn Street in its entirety between Peck Road and Myrtle Avenue located in the City of Arcadia, County of Los Angeles, State of California, more particularly described as follows: That portion of Dearborn Street shown on the map of Chicago Park Tract recorded in Book 30, page lOO of Miscellaneous Records in the Office of the Recorder of Los Angeles County lying between the southeasterly line of Peck Road, 100 feet wide, (shown as El Monte Road, 50 feet wide, on said map) and the northwesterly line of Myrtle Avenue as shown on said map. Said property is no longer required for public use; provided, that the public convenience and necessity require the reservation of a permanent easement and the right at any time, or from time to time, to construct, maintain, operate, ,replace, remove and renew water lines, sanitary sewers and storm drains and appurtenant structures in, upon, over and across the above-described property or part thereof, proposed to be vacated, and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, -1- 4475 f maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe- lines, telephone lines and lines for the transportation or distribu- tion of electrical energy in, upon, over and across the above- described property or part thereof, and these proceedings are taken subject to such'reservation. SECTION 2. The hearing will be set for the meeting of the City Council on February 4 , 1975, at 7:30 o'clock p.m. in the Council Chambers, Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, at which time any person interested in or objecting. to the proposed vacation and abandonment may appear and be heard. SECTION 3. Notice of the passage of this resolution and of the aforesaid hearing shall be posted in the manner required by law. SECTION 4. T~e City Clerk shall certify to the adoption of this resolution and shall cause the same to be published once in the Arcadia Tribune at least ten (lO) days before the date of said hearing.
