HomeMy WebLinkAbout5801 RESOLUTION NO. 5801 DOES A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REGARDING CONSISTENCY WITH THE GENERAL PLAN AND ORDERING THE VACATION OF EL MONTE AVENUE BETWEEN DUARTE ROAD AND CAMPUS DRIVE THE CITY COUNCIL OF THE CITY OF ARCADIA, HEREBY RESOLVE AND DETERMINE AS FOLLOWS: SECTION 1. The City Council of the Arcadia, on May 17, 1994, adopted Resolution No. 5793 declar'ng the intention of the Arcadia city Council to vacate El between Duarte Road and Campus Drive in the city County of Los Angeles, State of California. SECTION 2. Notices of the 0 sed street vacation were duly at the time required by street n H' hway Code, Section 8322. SECTION 3. The C~y ouncil of the City of Arcadia held a Public Hea~ing on t~~ osed street vacation on June 21, 1994, at 7:00 p.m. at the c~t~ 11 Council Chamber of the City of Arcadia, 240 West Hunting~ rive, Arcadia, California, at which time, said Council heard al evidence offered by persons interested in the City Council of the City of Arcadia does find: Code 65402, the proposed vacation nformity with the City's General Plan, b) That the vacation Mont~ Avenue between Duarte Road and Campus Drive as shown on attached Exhibit "A" is being made in accordance with Chapter and Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (Streets and Highways Code Section 8320 et. -1- Attachment 1 seq.); c)pursuant to Streets and Highway Codes section 8323, the city council finds from all the evidence submitted that El Monte Avenue between Duarte Road and Campus Drive is unnecessary for present or prospective street purposes, and theref e, it is ordered that the above described street be vacated, s to the following conditions, reservations, and exception . 1) to the Southern California permanent easement and right at any time, to construct, maintain, operate, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equ'pment and fixtures for the transportation or of electric energy, and incidental purposes in, and over the street, or part thereof proposed to be va Company the from time to or any time, or a permanent easement and right at to time to construct, maintain, renew and enlarge lines of pipe, wires, poles and other convenient ipment and fixtures for the operation of cable over the street, or part thereof proposed to be 2) to TCI operate, replace, conduits, structures, e in, upon vacated; the Arcadia Unified School District shall fund all and expenses incurred by the city including attorney with regard to any litigation that arises out of this vacation process, subject to whatever financial assurances are deemed advisable by the Arcadia City Attorney. SECTION 5. That the City Council hereby approves the Negative Declaration for the vacation of El Monte Avenue, between Duarte -2- S8'''( Road and Campus Drive, and finds it will not have a signifi ~t effect on the environment as long as the stated mitigated me sures are implemented. SECTION 6. That from and after the date 5801 is recorded, the vacated El Monte Avenue Road and Campus Drive will no longer constitute a publ' street. SECTION 7. The City Council of the cit of Arcadia does hereby order that El Monte Avenue between and Campus Drive be vacated after all of the followin conditions are met: a) Arcadia Unified all city's administrative costs. b) Arcadia Unified Improvement Agreement improvements. c) Arcadia District shall construct full height curb, gutter, parkway trees, and other off- site improvements Duarte Road and Campus Drive which may be required approval of Director of Public Works. d) School District shall pay for all with the construction of off-site District enters into an e city of Arcadia for off-site '. costs and drainage facilities such as plan checking, inspection charges, and all other necessary not specifically mentioned herein. e) R~servation of utility easement (for Southern Edison and TCI Cablevision) within which no permanent structure (building, etc.) is allowed.
