HomeMy WebLinkAbout5845 RESOLUTION NO. 5845 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CALLING ON THE STATE LEGISLATURE TO AMEND SECTION 6250 OF THE WELFARE AND INSTITUTIONS CODE TO PROVIDE A NEW CIVIL COMMITMENT AND COMMITMENT PROCEDURE RELATIVE TO SEXUALLY VIOLENT FELONS WHEREAS, there exists an extremely dangerous group of sexually violent predators in the State prison population; and WHEREAS, these sexual predators have personality disorders which can be identified while they are incarcerated; and WHEREAS, these persons are not safe to be at large; and WHEREAS, these persons represent a serious danger to the health and safety of others if released; and WHEREAS, current State law does not provide sufficient safeguards to protect society from sexual predators; and WHEREAS, current State law mandates the release of sexual predators into communities even though they pose an identifiable and serious danger to society. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. It is in the best interests of society to identify those individuals who pose an unreasonable risk due to their personality disorders prior to the expiration of their tenns of imprisonment, and once identified, to be confined and treated until such time that it can be detennined that they no longer pose a threat to society . SECTION 2. Support of an amendment to the Welfare and Institutions Code by creating an Article relative to Civil Commitment and Civil Commitment Procedure of Sexually Violent Predators, submitted as Exhibit "A" attached and made a part thereof. SECTION 3. All local agencies are urged to take appropriate action to notify their State legislative representatives and the Governor that they are in support of this California Welfare and Institutions Code amendment. SECTION 4. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION I. The Legislature finds and declares that a small Out e<tremely dangerous group of sexually violent predators that genera Ily have personality disorders can be identified while they are incarcerated. These persons are not safe to be at large and. if released. represent a danger to the health and safety of others. in that they are likely to engage in acts of 'iexua.l ,41 a 1 enc!. The Legislature finds and declares that it is in the interest of society to identify these individuals prior to the expiration of their terms of imprisor'!ment. tt is the intent of the Legislature tnat once identified. these individuals. if found to be likely to commit acts of sexually violent criminal beha"dor by clear and convincing evidence. be confined and treated until SUCh time that It can be determined they no longer present a threat to society. The Legislature further finds and declares that the treatment needs of this population are very long term, and the treatment modalities that are appropriate for this population are substantially different from those persons currently receiving mental health treatment unaer the Lanterman'Petris-Short Act (Part I, commencing with Section 5000 of Division 5 of the Welfare and Institutions Code) and, accordingly. a new civil commitment needs to be establiShed to address the treatment needs of this population. SECTION Z. Section 6ZS0 of the Welfare and Institutions Code is amended to read: 56ZS0 As used in this part, "persons subject to judic,,1 coml tment" means persons who may be judt c; a \1 y committed under this part as mentally disordered sex offenders pursuant to Art'cle 1 (commencing with Section 6300). sexually violent predators pursuant to Article 4 (commencing with Section 6600), or mentally retarded persons pursuant to Article Z (commencing with Section 6500 of Chapter Z of this part. Nothing In this part shall be held to change or interfere with the provisions of the Penal Code and other laws relating to mentally disordered persons charged with crimes or to the criminally insane. This part shall be liberally construed so tnat. as far as possible and consistent with the rights of persons suPject to commitment. those persons Shall be treated. not as criminals. but as. sick persons. SECTION 3. Article 4 (commencing with Section 6600) is adaea to Chapter Z of Part Z of Division 6 of the Welfare and Institutions Code to read: Article 4 Sexually Violent Predators 56600 As used in this article; the following terms have tne following meanings: (I) "Sexually violent predator" means a oerson whO I'1dS been convicted of a sexually violent offense and whO has a mental abnormality or personality disorder that makes the person a danger to the health and safety of others in that it is likely that he or sne will engage in sexually violent criminal behavior upon release from State prison. (b) "Sexually ,iolent offense" means the following acts committed on. before or after the effective date of this artIcle: a felony violation of Section Z61. Z6Z or Z64.1: suPdivis,on Ic), (d). (f). (g). (il. (j). or (k) of Section Z86: subdivision (C), (d). (fl. (g)". (i). (jl. or (k) of Section Z880: Section 188.5; subdivision (,). (b). (d). (e). (f). The facility shall be located on the grounds of dn institution under the jurisoiction of the Department of Corrections, (f) A petition for commitment shdll be fi1eo in the Superior Court of the county in which the person was convicted of the offense, for which he or she is under the jurisdiction of the Dep"tment of Corrections. The petition shall be fileo. dno the proceedings shall be handled, by either the district attorney or the county counsel of that county. The county bO"d of supervisors Shall designate ,either the district attorney or the county counsel to assume responsibility for proceedin9S under this "ticle. (91 The time limits set forth in suboivision (al and Section 660Z shall not apply during the first ye" that this article is operative. (h) Any independent professional who is designated by tne Director of Corrections or the Director of Mental Health for purposes of this section shall have at least five (5) ye"s of experience in the diaghosls ahd treatment at mental oisoroers. dnO shall include psychiatrists and licensed psychologists who hdve d doctoral degree in psychology. The requirements set forth in this section also shall apply to any professionals appointeo by tne court to evaluate the person for purposes of dny other proceedings unoer this article. 56602 A judge of the superior court shall review tne petition and Shall determine whether there is probable cause to believe that the individual named in the petition is likely to engage in sexually violent criminal behavior upon his or her release if the judge determines there is not probable Cduse, he or she shall dismiss the petition, If the juoge determines that there is probable cause, the judge shall order that a trial be conducted to determine whether the person is. by reason of mental abnormality or personality disoroer. a danger to the health ,nO safety of others in that the person is likely to engage in, acts of sexual violence upon his or her release from the jurisdiction of the Department of Corrections, 56603 (,) A person subject to this "ticle shall be entitleo to a trial by court. the assistance of counsel, the right to retain experts or professional persons to perform an exam1natton on hi s or her behalf. ano have access to ,II relevant meoical 'M psychological records and reports. I, 5845 56608 (a) Nothing in this article shall prohibit the cerson '.hO has been committed as a sexually violent predator from petit'onlng the court for conditional release and subsequent unconditional di scharge wi thout the recommendation or' concurrence of the Director of Mental Health. If a person has previously filed a petition for coMitional release without tn! concurrence of'the director and the court determined, eitner upon review of the petition or following a hearing. that the petition was frivolous or that the petitioner's condition had not so changeo that he or she would not be a danger to others if placed under supervision and treatment in the community, then the court shall oeny the subsequent petition unless It contains facts 'upon which a court could find that the conOition of the petitioner had so changeo that a hearing was warranted. Upon receipt of a first or subsequent petition from a commi tted person wi thout tne concurrence of the oi rector. the court sha 11 enoeavor whenever possible to review the petition ano Oetermine if it is based upon fr i va I ous ground sanO if so. sha 11 oeny the pet it i on without a hearing. (b) In no event shall a 'person who is committeo pursuant to this article be unconoitionally releaseO from commitment until he or she has been placed in the community under supervision and observation pursuant to this section for at least one year. (c) The court shall gi,e notice of the hearing oate to the attorney designateo in subdivision (f) of Section 6601. the retained or appointed attorney for the committeO person. and the Di rector of Mental Health at least IS court oays before the hearing date. (0) No hearing upon the petition shall be helo until the person who is committed has been under commitment for confinement and care in' a facility oesignated by the Director of Mental Health for not less than two years from the date of the order of comi tment. (e) The court shall halO a hearing to determi ne whether the person petitioning for conditional release would be a oanger to the health and safety of others due to his or her mental abnorma'ity or personality disoroer if under supervision and treatment in the community, If the court at the hearing determines that the petitioner would not be a danger to others Oue to his or her menta 1 abnorma lity or persona 11 ty d; soroer whi 1 e under super'ision and treatment in the communIty, the court snaIl order the petitIoner placed with an appropriate forensic conditional release program operated by the state for one year. . substantial portion of the state,operateO forensic conOitional release program shall include out'patient supervision and treatment. The court shall retaIn jurisdiction of the person throughout the course of the program, .t the enO of one year. the court shall hold a hearing to determine if the person shoulO be unconditionally released from commitment on the basis that. by reuon of a menta 1 abnorma 1 i ty or persona 11 ty disorder. he or sne is not a Oanger to the health and safety of others. The court shall not make this determination until the person has completeO at least one year in the state operated forensic conOitional release program. The court shall notify the director of Mental Health of the hearing date. (f) Before placing a petitioner In a state operateo forensic conditional release program. the community program director deslgnat~d by the State Department of Mental Health shall submit a written recommendation to the court stating whicn forensic conditional release program is most appropriate for supervtsin9 and treating the petitioner. If the court does not accept the community program director's recommendation, the court shall spec1fy the relson or reasons for its orOer on the recoro. The proceOures described 1n Sections 1605 to 1610, inclusive. of the Penal Code shall apply to the person placed 1n the forensic condttional release program.
