A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, AMENDING CITY COUNCIL
RESOLUTION NO. 6040 AND AUTHORIZING THE
TEMPORARY CLOSURE OF SOUTH FIRST AVENUE
BETWEEN AL TA AND CALIFORNIA STREETS PURSUANT TO
VEHICLE CODE SECTION 21101(e) ON SATURDAY
MORNINGS FROM 7:00 AM TO 2:00 PM FROM JANUARY 1
TO DECEMBER 31 ANNUALLY
WHEREAS, the Arcadia Business Association, a non-profit association of downtown
businesses has received City Council authorization pursuant to City Council Resolution No.
6040 for temporary closure of South First Avenue between Alia Street and California Street on
Saturday mornings from 6:00 a.m. to 1:00 p,m, beginning April 18, 1998 through October 31,
1998 for purposes of operating a downtown Farmers Market; and
WHEREAS, the Farmers Market has been successful for the downtown merchants, the
farmers, the Arcadia Business Association, the City of Arcadia, the Arcadia Redevelopment
Agency and the community; and
WHEREAS, the Arcadia Business Association is requesting a change in operating
hours for the Market from 7:30 a.m. to 12:00 p,m., to 8:00 a.m. to 1:00 p,m" with South First
Avenue to be closed from 7:00 a.m. to 2:00 p.m. (see Exhibit 1); and
WHEREAS, the Arcadia Business Association is also requesting authorization to
operate the Market from January 1 to December 31 annually (see Exhibit 1); and
WHEREAS, the Arcadia Business Association has submitted a petition signed by a
majority of the South First Avenue merchants in support of both requests; and
WHEREAS, the California Vehicle Code Section 21101(e) permits such closure for
special events; and

WHEREAS, the City Council has previously adopted the Farmers Market Street Closure
Regulations which regulate the operations of the Arcadia Business Association's sponsored
Farmers Market on South First Avenue, and which have been revised to reflect the two
requests of the Arcadia Business Association (see Exhibit 2),
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That Section 1 of City Council Resolution No. 6040 is hereby amended
to read as follows:
"That the temporary closure of South First Avenue between East Alia
Street and California Street on Saturday mornings from 7:00 a.m, to 2:00 p.m.
from January 1 to December 31 annually for the purposes of a downtown
Farmers Market as necessary for the safety and protection of the farmers, local
merchants and their customers, pursuant to Vehicle Code Section 21101(e), in
order to implement the special event described herein as a Farmers Market, is
approved."
SECTION 2. That the City Council hereby adopt the amended Farmers Market Street
Closure Regulations as set forth in Exhibit 2.
SECTION 3. That the City Council may repeal this Resolution at any time.
SECTION 4. That William R, Kelly, City Manager, or his designee, is authorized to
make minor revisions to these Regulations as the need may arise, and major revisions subject
to ratification by the City Council.
.SECTION 5, That except as amended herein, Resolution No, 6040 remains in effect,

SECTION 6. That the City Clerk shall certify to the adoption of this Resolution.

FARMERS MARKET STREET CLOSURE REGULATIONS

1) South First Avenue shall be closed by the use of barricades as shown on the site rna~,
Exhibit 1.
a) Barricades on South First Avenue shall be located immediately south of the cross
walk at Alta Street immediately north and south of the crosswalk at Bonita Street,
and immediately north of the crosswalk at California Street.
b) Barricades in the alleys between Alia/Bonita and BonilalCalifomia both east and
west of First Avenue shall be placed near the rear of the buildings fronting on south
First, such that cars can gain access to the rear parking lot of these stores,
c) In the event Bonita Street is closed in the future, barricades shall be placed on
Bonita immediately east or west of the driveway at the rear of the stores fronting on
South First Avenue, such that cars can tum into the driveway in order to gain
access to the rear parking lot of these stores.
d) In the event Bonita Street is closed in the future, a sign shall be placed in the center
of Bonita near South Santa Anita and near South Second warning drivers that First
A venue is closed to thru-traffic.
2) Closure shall not occur before the hour of 7:00 a.m., nor after the hour of 2:00 p.m., on
Saturday momings, between January 1 to December 31 annually.
3) The Arcadia Business Association shall place barricades weekly in position as shown
on Exhibit 1, subject to Police Department approval, and shall rernove and store them
in a safe, unobtrusive location out of the public right-of-way during the week while not in
use. The ABA shall maintain the barricades in good condition and shall replace any
barricades damaged beyond repair or missing.
4) The ABA shall ensure that farmers display tables, tents, trucks or merchandise do not
block: a) access for an.~mergency vehicle on FirstAvenue; b) pedestrian traffic on the
adjacent sideWalks on SoUth First Avenue:' .. .

Any refuse coilection bins 'or boxes shall be ,stored at curbside in a parking space on
AlIa, Bonita. or califOrriia Streets, pending pick~up by the servicing company no later
than the following MorrdaY...Jhe.ania_aJOuridthe biii~.,shall.be free of debris and litter.

Any portable r:estrooms and the area surrounding them shall be kept clean pending
, pick-up by the servicing company no later than the following Monday.

7) Use of any sound system requires written pre-approval from the Development Services
Director.
8) Any directional or promotional signage shall be made of sturdy, weather-resistant
material designed and composed attractively, and placed in safe location in accordance
with City ordinances and Police requirements, The design, text and location of all AtlA
signs shall be approved by the Development Services Director.
9) Any damage to existing City facilities or landscaping caused by the operations of the
Farmers Market or their patrOns shall be replaced in kind, or reimbursed, by the ABA to
the satisfaction of the Maintenance Services Director. Use of City water or power shall
be pre-approved in writing, and the ABA shall pay the City for such usage.
10) The Police Chief, Fire Chief or Maintenance Services Director may close part or all of
the Farmers Market in the event of an emergency. The ABA shall cooperate at all
times with City representatives in the operations of the Farmers Market.
11) The ABA shall at all times have an experienced, knowledgeable representative in
charge on Saturday momings from 7:00 a.m. to 2:00 p.m. during the Farmers Market.
12) The ABA shall ensure that the Market is a State Certified Farmers Market, that the
farmers comply with all State, County and City Health and Nuisance Abatement laws.
13) The ABA shall indemnify and hold harmless the City of Arcadia and the Arcadia
Redevelopment Agency from and against all claims, suits and liabilities for damage to
person or property arising out of the ABA's errors, omissions or negligent acts.
14) The ABA shall carry Commercial Uability Insurance with combined single limits of at
least $1 million dollars naming the City of Arcadia and the Arcadia Redevelopment
Agency as additional insured, subject to approval by the City Attorney.
15) These regulations implement and detail the duties and responsibilities of the Arcadia
Business Association as set forth in the contract agreement by and between the
Arcadia Business Association and the Arcadia Redevelopment Agency dated January
27,1998. This may be.supplemented as need ~rises by certain field conditions. Minor
revisions may also be made by the City ManagerlExecutive DirectOr since/as conditions
may change.
