HomeMy WebLinkAbout6061 RESOLUTION NO. 6061 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA ORDERING THE VACATION AND ABANDONMENT OF AN ALLEY WEST OF SECOND AVENUE AND SOUTH OF SANTA CLARA STREET NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That on recornrnendation of the of the Developrnent Services Department's Engineering Division of the City of Arcadia, Resolution No. 6052 was adopted declaring the intention of the Arcadia City Council to vacate and abandon an alley west of Second Avenue and south of Santa Clara Street, in the City of Arcadia, County of Los Angeles, State of California, more particularly shown in Exhibit" An attached hereto and described as follows: THAT PORTION OF THAT CERTAIN ALLEY (20 FEET WIDE) AS SHOWN ON MAP OF "A PART OF ARCADIA SANTA ANITA TRACT", IN THE CITY OF ARCADIA, AS PER MAP RECORDED IN BOOK 15 PAGES 89 AND 90 OF MISCELLANEOUS RECORDS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, INCLUDED WITHIN BLOCK 77 OF SAID MAP OF . A PART OF ARCADIA SANTA ANITA TRACT"; BOUNDED ON THE WEST BY THE SOUTHERLY PROLONGATION OF THE WESTERLY LINE OF LOT 22 IN SAID BLOCK 77 AND BOUNDED ON THE EAST BY THE SOUTHERLY PROLONGATION OF THE EASERLY LINE OF LOT 16 IN SAID BLOCK 77. A public hearing was duly held on July 21, 1998, on posted notice and publication of Resolution No. 6052 at the hour of 7:00 p.m. in the Council Charnbers of 2 98 -1624255 6061 Arcadia City Hall, 240 W. Huntington Drive, Arcadia, California, for the purpose of \ hearing all persons interested in or objecting to the proposed vacation and abandonment of an alley west of Second Avenue and south of Santa Clara Street. At said hearing, the City Council accepted and received all testimony offered in support of, or in objection to the proposed vacation. SECTION 2. That the vacation is being made in accordance with Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (Streets and Highways Code Section 8320 et. seq.). SECTION 3. That the City Council finds from the evidence subrnitted that the alley described in Section 1 above and as included in the Resolution of Intention to Vacate and Abandon (Resolution No. 6052), is unnecessary for present or prospective street purposes, and therefor, it is ordered that the above described alley be vacated, subject to reserving and excepting frorn the vacation: a) an easernent for Pacific Bell to frorn tirne to tirne construct, rnaintain, operate, replace, rernove, and renew such aerial and underground communication facilities (including ingress thereto and egress therefrom) consisting of poles, anchors, guys, cables, wires, crossarms, conduit, manholes, hand holes, rnarkers, pedestals, terrninal equiprnent cabinets, electrical conductors and necessary fixtures and appurtenances. b) an easernent for The Gas Company to frorn tirne to tirne construct, rnaintain, operate, replace, rernove, and renew such underground facilities as necessary to provide Gas Cornpany service. 98 1624255 3 6061 c) an easernent for Southern California Edison to frorn tirne to tirne construct, maintain, operate, replace, remove, and renew such aerial and underground electric transmissiorn facilities (including ingress thereto and egress therefrornl consisting of poles, anchors, guys, cables, wires, crossarms, conduit, transformers, manholes, hand holes, markers, pedestals, terminal equiprnent cabinets, electrical conductors and necessaiy fixtures and appurtenances. SECTION 4. Pursuant to the Streets and Highways Code Section 8324, the City Council finds frorn the evidence subrnitted that the alley described in Section 1 above and included in the Resolution of Intention to Vacate and Abandon (Resolution No. 6052), is unnecessary for present of prospective public use, and therefor, it is ordered vacated, subject to reservations in Section 3. SECTION 5. Pursuant to provisions of Section 2381 of the Streets and Highways Code of the State of California, This Council does hereby find and determine that the alley described in Section 1 is not useful as a bicycle path or route. SECTION 6. That pursuant to Section 65402 of the Governrnent Code and the findings rnade by the Arcadia Planning Cornrnission in their rneeting of May 21, 1998, vacating the alley described in Section 1 is in conforrnity with the City's General Plan. 4 98 1624255 6061 SECTION 7. That the City Council hereby approves the Negative Declaration (Exhibit "Bn) for the vacation and abandonrnent and finds that it will not have a significant impact on the environrnent. SECTION 8. That from and after the date that Resolution No. 6061 is recorded, the vacated alley described in Section 1 above will no longer constitute a public street. SECTION 9. That the City Clerk shall certify to the adoption of this Resolution and shall cause a certified copy thereof to be recorded in the Office of the County Recorder of Los Angeles County. SECTION 10.
