RESOLUTION NO. 6063
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DECLARING INAPPLICABILITY
OF PREVAILING WAGE RATES TO CITY PUBLIC WORKS
PROJECTS EXCEPT WHERE REQUIRED BY LAW
WHEREAS, Section 200 of the Arcadia City Charter provides, in part, as follows:
Section 200. The City shall have the power to make and enforce all
laws and regulations in respect to municipal affairs, subject only to
such restrictions and limitations as may be provided in this Charter
and in the Constitution of the State of California.
WHEREAS, Arcadia presently has no provisions oflaw mandating prevailing wage
rates either in the City Charter or City Ordinances; and
WHEREAS, the State Labor Code requires that contractors on public works projects
pay workers the prevailing wage; and
WHEREAS, the City has determined that it is in the best interest of the community
to formally exempt itself from any prevailing wage requirements in those situations where
this is legally authorized; and
WHEREAS, Arcadia as a Charter City shall govern its own municipal affairs.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION L With the exception of those projects set forth in Section 2 below
(Exceptions), there shall be no prevailing wage rate requirements applicable to the City of
Arcadia for public works projects as set forth in State Labor Code Sections 1770 et. seq.

Subject to Section 2 below, Arcadia is exempt from the payment of prevailing wages for
public works contracts.
SECTION 2. EXCEPTIONS. Section I above shall not apply to public works
projects that involve the utilization of state or federal monies. Section 1 shall not apply to
public works projects that are of state of concern i.e. not a municipal affair.
SECTION 3. That the City Clerk shall certify to the adoption of this Resolution.
