HomeMy WebLinkAbout6066 RESOLUTION NO. 6066 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA APPROVING THE DESTRUCTION OF CERTAIN POLICE DEPARTMENT RECORDS, DOCUMENTS, AND PAPERS, PURSUANT TO SECTIONS 34090 AND 34090.6 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA. WHEREAS, The Chief of the Arcadia Police Department has subrnitted a request for authority to destroy obsolete records; and WHEREAS, Governrnent Code Sections 34090 and 34090.6 authorize destruction of certain records, docurnents, recordings, instrurnents, books, or papers a City Departrnent Head if authorized by the City Council and consented to in writing by the City Attorney, without rnaking a copy thereof, after sarne is no longer required; NOW, THEREFORE, THE CITY COUNCil OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOllOWS: SECTION 1. The following City records, docurnents, instruments, books or papers are no longer required and rnay be destroyed subject to the conditions set forth herein. (a) Recordings of telephone and radio cornrnunications over one hundred (100) days old, provided such recordings are not evidence in any clairn filed or any pending litigation (or potential clairns and litigation). in which case such recordings shall be preserved until pending litigation is resolved. (b) Auction receipts and records over two (2) years old. (c) Records of expired licenses and perrnits over two (2) years old. (d) Records of lost and found iterns, which lost and found iterns have been lawfully disposed of, over two (2) years old. (e) Police Daily Activity records and logs over two (2) years old. (f) All crime and supplernental reports of infractions, misderneanors, and felonies over five (5) years old provided: (1 ) They do not relate to an arrest. (2) They do not relate to any unserved warrants. 6066 -1- (3) They do not relate to registrants pursuant to Penal Code Section 290 or Health and Safety Code Section 11590. (4) They do not involve identifiable items which have not been recovered and such iterns are rnaintained in the California Department of Justice data bases. (5) They do not relate to a crirninal death case. (6) They do not relate to violations listed in Penal Code Sections 799 and 800. (7) The cases are not presently involved in either civil or crirninal litigation. (g) All index cards and logs which relate to the case docurnents destroyed. (h) Police dispatch cards over two (2) years old. (i) Field investigation cards over two (2) years old. (j) P.O.S.T. (Peace Officers Standards and Training) training reirnbursernent request forrns and related training expense receipts over two (2) years old. (k) S.T.C. (Standards and Training for Corrections) training reirnbursernent request forrns and related training expense receipts over two (2) years old. (I) Traffic citations over two (2) years old. (rn) Alarrn cards over two (2) years old. (n) Payroll docurnents and forrns over two (2) years old. (0) Purchase order forms over two (2) years old. (p) Miscellaneous receipts (for sales of reports, fingerprinting services, visa clearance letters, citation verification service, reproduction of photographs, vehicle irnpounds, and cornrnunity service workers) over two (2) years old. (q) Bail receipts over two (2) years old. (r) Court Ordered sealings of juvenile records over five (5) years old. -2- 6066 STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES ) SS: CITY OF ARCADIA ) I, JUNE D. ALFORD, City Clerk of the City of Arcadia, hereby certify that the foregoing Resolution No. 6066 was passed and adopted by the City Council of the City of Arcadia, signed by the Mayor and attested to by the City Clerk at a regular meeting of said Council held on the 18th day of August, 1998 and that said Resolution was adopted by the following vote, to wit: AYES: Councilmember Chandler, Harbicht, Marshall, Roncelli and Kovacic NOES: None ABSENT: None -3- 6066 (s) Factually Innocent sealings of arrest records (per 851.8 of the Penal Code) over five (5) years old. SECTION 2. Except where otherwise precluded by statute, all iterns noted above rnay not be destroyed without the written consent of the City Attorney. Iterns shall not be destroyed if they are subject to or in any way related to litigation. SECTION 3. The records, docurnents, instrurnents, books and papers specified in paragraph 1 of this Resolution do not include: Any docurnents relating to citizen cornplaints or investigations in response to citizen cornplaints relating to rnernbers of the Police Department and internal affairs investigation files. SECTION 4. Resolution. That the City Clerk shall certify to the adoption of this Passed, approved and adopted this' 18th day of August, 1998. ATTEST: APPROVED AS TO FORM: -4- 6066
