HomeMy WebLinkAbout6067 RESOLUTION 6067 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPEAL AND UPHOLDING THE PLANNING COMMISSION'S ACTION IN UPHOLDING THE RANCHO SANTA ANITA PROPERTY OWNERS ASSOCIATION'S ARClllTECTURAL REVIEW BOARD'S DENIAL OF A PROPOSED TWO-STORY SINGLE- FAMILY RESIDENCE AT 1035 HAMPTON ROAD. WHEREAS, the proceedings that are the subject of this Resolution are authorized by Arcadia Municipal Code Sections 9272.1., et seq. (D Architectural Design Zone), and WHEREAS, City Council Resolution No. 5288 sets forth the regulations applicable to the property within the Rancho Santa Anita Property Owners Association's area and to the property at 1035 Hampton Road, Arcadia, in accordance with Arcadia Municipal Code Section 9272.2.3., and WHEREAS, on May 14, 1998, the project manager, Tom Dargan, on behalf of the property owner, Anne Ma, filed an appeal of the Planning Commission's action in upholding the Rancho Santa Anita Property Owners Association's Architectural Review Board's (ARB) denial of their proposal for a 10,199 sq.ft., two-story residence, which includes a related front yard modification and a oak tree removal request, at the property commonly known as 1035 Hampton Road, more particularly described as follows: Lot 16 of Tract No. 11204, in the City of Arcadia, County of Los Angeles, State of California, as per Map Recorded in Map Book 197, Pages 18, 19 and 20 in the Recorder's office of said County. WHEREAS, the appeal to the City Council was preceded by a noticed hearing before the Architectural Review Board of the Rancho Santa Anita Property Owners' Association on March 18, 1998; and WHEREAS, a public hearing was held on April 28, 1998, by the Planning Commission, at which time all interested persons were given full opportunity to be heard and to present evidence; and 6067 WHEREAS, per the applicant's request, the public hearing before the City Council on June 2, 1998, was continued to the Council's July 21, 1998 meeting to allow the project manager, Mr. Tom Dargan, and the property owner, Mrs. Anne Ma, to meet with the ARB to discuss changes to their proposal. Meetings were held by the ARB on June 22 and July 13 at which time changes were discussed among the Board members and Mr. Dargan. On July 14 Mr. Dargan informed the City that they could not resolve the issues with the ARB , and therefore wish to proceed with the appeal, as originally submitted. WHEREAS, as part of the record, the City Council reviewed and considered: a. Copies of the June 22 and July 13 ARB minutes, b. A vernal and written presentation of the Development Services Department staff report and related attachments which include the Rancho Santa Anita Property Owners Association's Architectural Review Board's findings and actions of March 18, 1998, and City Council Resolution No. 5288 which sets forth the regulations that are applicable to the real property within the Rancho Santa Anita Property Owners Association's area. c. Letters from Tom Dargan, project manager, appealing the decisions of the Planning Commission and ARB, on behalf of the property owner. d. All oral presentations, testimony, and documentation made and presented during the public hearing of July 21, 1998. e. Plans of the proposed residence, and a map of the involved properties. f. A photo-board, scaled model and plan exhibit, prepared by the ARB, illustrating the comparison of the proposed development in contrast to the neighboring structures. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY FIND AND RESOL YES AS FOLLOWS: Section 1. That the information submitted by the Development Services Department in the attached report is true and correct. Section 2. That the design of the home is incompatible with the neighborhood because its massiveness makes an architectural statement that is different from the other residences i.e" the proposed residence is out of proportion in relationship to the height 2 6067 and mass of the smaller neighboring structures. In addition, the proposed front yard setback is inadequate, Such a setback of 55' -0" to 69'-0" in lieu of the 86' -6" required by Code will not provide for a reasonable relationship between the adjacent front yards, That based on the submitted site plan of the subject property (approximately 29,000 sq.ft. oflot area), it is the opinion that an architect should be able to design a home that meets the needs of the property owner without necessitating the removal of any oak tree. Section 3. That for the foregoing reasons this Council denies the appeal, and upholds the Planning Commission's action in upholding the Rancho Santa Anita Property Owners Association's Architectural Review Board's denial as reflected in their findings which are incorporated by reference. Section 4. The decision and findings contained in this Resolution reflect the City Council's action of July 21, 1998, and the following vote: A YES: Council members Chandler, Harbicht, Marshall, Roncelli and Kovacic NOES: None ABSENT: None Section 5, The City Clerk shall certify to the adoption of this Resolution.
