HomeMy WebLinkAbout6081 RESOLUTION NO. 6081 , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 14 THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: WHEREAS, the City Council of the City of Arcadia, at its regular meeting of November 3, 1998, held a public hearing at the hour of 7:00 o'clock p.m., in the City Council Chambers at the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City described as follows: Santa Anita Avenue That portion of a Map of Part of Santa Anita Tract as shown on map recorded in Book 34, Pages 41 and 42 of Miscellaneous Records in the Office of the Recorder of Los Angeles County, bounded as follows: On the north by the prolongation of the southerly right-of-way line of Colorado Boulevard; on the east by the easterly right-of-way line of Santa Anita Avenue; on the south by the northerly right-of-way line of Huntington Drive; on the west by the westerly right-of-way line of Santa Anita Avenue. -1- 6081 Santa Clara Street (East of Santa Anita Avenue) That portion of a Map of Part of Arcadia Santa Anita Tract as shown on map recorded in Book 15, Pages 89 and 90 of Miscellaneous Records in the Office of the Recorder of Los Angeles County, bounded as follows: On the east by the prolongation of the westerly right-of-way line of First Avenue; on the north by the right-of-way line of Santa Clara Street; on the west by the prolongation of the easterly right-of-way line of Santa Anita Avenue; on the south by the southerly right-of-way line of Santa Clara Street. Santa Clara Street (West of Santa Anita Avenue) A portion of Tract Number 949 as shown on map recorded in Book 17, Page 13 of Miscellaneous Records in the Office of the Recorder of Los Angeles County, bounded as follows: On the south by the prolongation of the northerly right-of-way line of Huntington Drive; on the west by the westerly right-of-way line of Santa Clara Street; on the east by the easterly right-of-way line of Santa Clara Street; on the north by the prolongation of the westerly right-of-way line of Santa Anita Avenue. Morlan Place Morlan Place, in the City of Arcadia, shown as Morlan Place, Tract 13768, as shown on map recorded in Book 273, Page 37 of Miscellaneous Record in the Office of the Recorder of Los Angeles County, bounded as follows: On the south by the prolongation of the northerly right-of-way line of -2- 6081 Huntington Drive; on the northwest and southeast by the right-of-way lines of Morlan Place; on the east by the prolongation of the westerly right-of-way line of Santa Anita Avenue. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, THE COUNCil OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOllOWS: SECTION 1. That pursuant to Ordinance No. 1375 of the City of Arcadia, the above-described area is hereby declared an underground utility district and is designated as Underground Utility District No. 14 of the City of Arcadia. SECTION 2. That the City Council does hereby fix March 17, 2000 as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication of similar or associated service with Underground Utility District No. 14 on or before December 31,2000. SECTION 3. That the City Council of the City of Arcadia hereby finds and determines that the public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and associated structures, and the underground installation of wires and facilities for -3- 6081 supplying electric, communication of similar or associated service in said area. SECTION 4. That the City Council finds and determines: a. That the undergrounding to be accomplished pursuant to this resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. b. The streets, road or right-of-ways in said area are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. SECTION 5. The City Clerk, within ten (10) days after the adoption of this Resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment role and to the affected uti I ities. Said City Clerk shall further notify such affected property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, or similar or associated service, they or such occupant shall provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location. SECTION 6. That the City clerk shall certify the adoption of this Resolution. Passed, approved, and adopted this 3'd day of November 1998.
