HomeMy WebLinkAbout5564 RESOLUTION NO. 5564 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AUTHORIZING THE CHIEF OF POLICE TO DESTROY lOO DAY OLD COMMUNICATION RECORDINGS AS AUTHORIZED BY GOVERNMENT CODE SECTION 34090.6 WHEREAS, the Arcadia Police Department has a telephone-radio recording system; and WHEREAS, it is necessary to reuse the recording tapes on a lOO day basis; and WHEREAS, California Government Code section 34090.6 authorizes the destruction of telephone and radio communications subject to approval by the City legislative body and written consent of the City Attorney. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION l. The Chief of Police through his designated agents is authorized and the City Council approves of his destruction of routine daily tapings and recordings of telephone communications to and from the City and all radio communications relating to the operations of the Police Department, after said recordings are lOO days old, subject to the prior written consent of the city Attorney. SECTION 2. It is understood that in the event such recordings are evidence in any claim filed or any pending litigation, such recordings shall be preserved until the pending litigation is resolved. 5564 SECTION 3. That the City Clerk shall certify to the adoption of this Resolution.
