HomeMy WebLinkAbout5566 RESOLUTION 5566 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, TAKING ACTION ON CERTAIN CONDmONS OF CONDmONAL USE PERMIT 90-016 AN AUTO BODY SHOP AT 42 WEST LIVE OAK AVENUE WHEREAS, on October 15,1990 an application was filed by William Skibsted to allow the expansion of an existing auto body shop, Planning Department Case No, c.u.p, 90-016 at 42 West Uve Oak Avenue, more particularly described as follows: Lot 1 of Tract 10898, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 8573, Page 19 inclusive of maps, in the office of said County Recorder. WHEREAS, a public hearing was held before the Planning Commission on November 13, 1990; and WHEREAS, after the public hearing the Planning Commission voted 5-0 to approve Conditional Use Permit 90-016 and adopted Planning Commission Resolution 1449 reflecting their decision; and WHEREAS, on December 4, 1990, Mr, Skibsted appealed the following three conditions of approval of Resolution 1449: (1) Removal of the razor wire along Welland Avenue; (2) Installation of free standing light poles in lieu of lights attached to the existing wood power poles; and (3) Installation of Fire Sprinklers in the carport area at the front of the building. WHEREAS, on January 2 and January 15, 1991, the City Council heard the appeal on the three conditions; and WHEREAS, as part of the record of these hearings the City Council reviewed and considered: a. All staff reports and related attachments and exhibits submitted by the Planning Department to the Planning Commission and City Council. b. The record of the Planning Commission hearing regarding C.U.P, 90-016, c. All oral presentations and testimony made during the public hearings on January 2 and January 15, 1991. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Council finds that: (1) the maximum wall height allowed in the City is 6'-0" and the applicant has a choice to either remove the razor wire and barbed wire or reduce the wall height to accommodate the razor wire and barbed -1- 5566 wire at a maximum height of 6'-0"; (2) based upon information presented, there are no plans in the near future to underground the utilities within this area and, therefore, the requirement to install new concrete light standards is not reasonable at this time; and (3) that the applicant should adhere to the Fire Department's requirement for the sprinkler system within the carport and paint booth, Section 2, That for the foregoing reasons the City Council voted 5-0 to deny the appeal relating to conditions 1 and 3 as set forth on Page 1 of this Resolution and to grant the appeal, in part, by adopting condition No.2. Section 3, CU.P, 90-016 is approved subject to compliance with all conditions as approved by the Planning Commission and final action of the City Council on the appealed conditions which shall read as follows: 1. The maximum height of the wall, induding razor wire and barbed wire along Welland Avenue shall not exceed 6'-0", 2. The installation of two street lights on Welland Avenue may be located on the existing wood poles, 3. Fire sprinklers shall be installed in the entire structure induding the carport and the paint booth, Section 4. The City Clerk shall certify to the adoption of this Resolution.
