HomeMy WebLinkAbout5588 RESOLUTION NO. 5588 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DENYING AN APPEAL OF THE PLANNING COMMISSION'S APPROVAL OF APPLICATION NO. MC 91-017, THEREBY APPROVING A TWO-STORY ADDITION WITH SECOND FLOOR SIDE SETBACK MODIFICATIONS AT 2050 VISTA AVENUE, WITH FINDINGS (HIGHLAND OAKS HOMEOWNER'S ASSOCIATION - HOA AND ARCHITECTURAL REVIEW BOARD - ARB) WHEREAS, the proceedings that are subject to this Resolution are authorized by Arcadia Municipal Code Sections 9272.1 et seq. (D Architectural Design Zone), and WHEREAS, Resolution No. 5289 sets forth the regulations applicable to the Highland Oaks Design Zone Area and to the property at 2050 Vista Avenue, Arcadia, per Arcadia Municipal Code Section 9272.2.3., and WHEREAS, on April 15, 1991, an appeal was filed by Norma Iovine of the Arcadia City Planning Commission's April 9, 1991 approval of Modification Application No. MC 91-017 for a two-story addition to the rear of the house located at 2050 Vista Avenue, more particularly described as follows: Lot 23, Tract 18702 in the City of Arcadia, County of Los Angeles, State of California as per Map recorded in Map Book 590, Pages 5, 6, and 7 in the recorder's office of said County. WHEREAS, the appeal to the City Council was preceded by a noticed hearing before the City Planning Commission on April 9, 1991; and WHEREAS, on May 21, 1991 the City Council held a public hearing to consider the appeal and at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, as part of the record, the City Council reviewed and considered: a. A verbal and written presentation of the City Council staff report and related attachments including the Highland HOA's ARB's findings and actions of February 25, 1991 and Resolution No. 5289 setting forth the regulations applicable to real property in the Highland Oaks Architectural Design Zone Area. 5588 b. Written communications submitted by Norma Iovine, the appellant; Richard C. Wilson, a neighbor at 2066 Vista Avenue; and, Ralph 1. Bicker, Chairman of the Highland HOA ARB. c. All oral presentations, testimony, and documentation made and presented during the public hearing of May 21, 1991. d. Plans of the proposed addition, and photographs and maps of the involved properties. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND AND RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Arcadia denies the appeal and affirms the decisions of the Planning Commission and Highland HOA's ARB based on the following findings, the determination made by the Planning Commission, and the Highland HOA ARB findings which are incorporated by reference: a. There is no basis to remand the appeal to the ARB or Planning Commission. b. Second floors are not prohibited by any of the regulations, criteria, or guidelines of the City of Arcadia or of the Highland HOA. The second floor addition is compatible with the neighborhood. The second story is a matter of right pursuant to Arcadia's zoning code. The right to a two-story home at the subject location has existed since the construction of the subject residence. c. That the proposed addition is architecturally harmonious and compatible with the surrounding neighborhood. It is in proportion with the subject property and with other properties in the neighborhood. In addition, its design adds minimally to the visual mass of the building because the second floor has been limited to the rear portion of the building. The external appearance is therefore not detrimental to the amenities and value of the adjacent property and the neighborhood. d. While any second floor additions will have an impact upon the neighborhood's appearance as well as upon the view from neighboring properties, the granting of the second floor side setback modifications reduces the length of the addition and increases its distance from the front of the property thereby further reducing the impacts of the second floor. e. The view from the neighbor's property is from the second floor of their house. The proposed addition has been located so as to minimize its impact upon -2- 5588 the neighbor's view and to have a minimum visual impact upon the neighborhood. f. Approval of the proposed addition would prevent an unreasonable hardship and the project as designed would accomplish the objectives of the ARB's resolution. The primary purpose of Arcadia's setback requirements to mitigate the bulk appearance of houses, particularly from the street view, is not frustrated by the requested modification. SECTION 2. The decision and findings contained in this Resolution reflect the Council's action of May 21, 1991 by the following vote: AYES: Councilmembers Ciraulo, Fasching, Harbicht, Youl).g and Gilb NOES: None ABSENT: None SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
