A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA
DENYING WITH FINDINGS THE APPEAL OF MR. AND MRS, WAYNE
BROOKS OF THE PLANNING COMMISSION'S DENIAL TO ALLOW
THREE LIMOUSINES IN LIEU OF ONE AS PERMTITED BY HOME
OCCUPATION PERMIT 85-124 AT 136 WEST LA SIERRA DRIVE,
WHEREAS, on October 17, 1988, the Planning Department received a letter
from Mr, and Mrs, Wayne Brooks appealing the condition of approval of Home
Occupation Permit 85-124 which allowed the operation of a limousine service at 136
West La Sierra Drive subject to the condition that only one limousine be allowed on
the premises. Mr, and Mrs, Brooks were requesting approval to allow three
limousines to be parked on the premises at 136 West La Sierra Drive.
WHEREAS, on November 8, 1988 the Planning Commission heard all public
testimony and denied the appeal; and
WHEREAS, on November 17, 1988, Mrs. Wayne Brooks appealed the
Planning Commission's denial; and
WHEREAS, on January 17, 1989, the City Council heard the appeal; and
WHEREAS, as part of the record, the City Council reviewed and considered:
a, The staff report and related attachments,
b. Written communications submitted by the appellant and interested
citizens in favor of and in opposition to the expansion of the limousine service.
c. All oral presentations and testimony made during the public hearing on
January 17, 1989.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
HEREBY FIND AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Arcadia denies the appeal and
upholds the Planning Commission's denial and finds that:
1. Home occupations are allowed in residential zones if the occupation is
virtually invisible and not offensive to other residents of the neighborhood.
2. The limousines should be stored in the proper commercial area, not in a
residential area and that three limousines were too intense and not compatible with
a residential environment. The activity related to and generated under Home
Occupation Permit 85-124 by the violations of that permit by appellants is

incompatible to a residential zone and does nothing to upgrade the living
environment of the Community.
3, The request is contrary to the welfare, peace, quiet and enjoyment of the
surrounding property within the neighborhood and inconsistent with the
requirements of the Arcadia Municipal Code that Home Occupations maintain
compatibility with the residential neighborhoods. The activities of appellant which
they seek to perpetuate by removing the "one limousine only" requirement is
tantamount to conducting a business in a residential zone,
Section 2, That for the foregoing reasons this Council denies the appeal with
the finding that one limousine be allowed as per the original Home Occupation
Permit 85-124 and that the applicants be allowed a maximum of sixty (60) days of the
City Council's action (by March 17, 1989) to remove the other limousines,
SECTION 3, The City Clerk shall certify to the adoption of this Resolution.
