RESOLUTION NO. 5468
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DENYING WITH FINDINGS, AN
APPEAL OF THE PLANNING COMMISSION'S APPROVAL OF
T.P.M. 89-01 TO CREATE THREE NEW SINGLE FAMILY
LOTS FROM ONE EXISTING LOT AT 1000 SOUTH FOURTH
AVENUE
WHEREAS, on January 3, 1989, an application was filed by Chris
Construction Company, Inc. to create three lots from one lot at 1000
South Fourth Avenue and to realign the lot line at 411 Scott Place,
Planning Department Case No., T.P.M. 89-01, more particularly
described as follows:
Portions of Lots 48 and 49, Tract No. 808, in the City
of Arcadia, County of Los Angeles, State of California
as per map recorded in Map Book 16, Pages 82 and 83 and
Lot 4 of Tract No. 44700 in the City of Arcadia, County
of Los Angeles, State of California as per map recorded
in Map Book 1075, Pages 1 and 2 as recorded in the Office
of the County recorder of said County.
WHEREAS, on January 21, 1989, the Planning Commission heard all
public testimony and approved Tentative Parcel Map 89-01 subject to
the conditions outlined in the staff report and the additional
condition that Lot 1 be increased to 80'-0" in width and Lot 2 be
60.66' in width at the front property line;
WHEREAS, on February 2, 1989, Harold Ellis appealed the
Planning Commission's approval; and
WHEREAS, on February 21, 1989, the City Council heard the
appeal; and
WHEREAS, as part of the record, the City Council reviewed and
considered:
a. The staff report and related attachments including the
"record" of the Planning Commission's action.

b. All oral presentations, written material received on
February 21st and at other times, and testimony made during the
public hearing on February 21, 1989.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY DECIDE, FIND AND RESOLVE AS FOLLOWS:
SECTION 1. DECISION. A Negative Declaration is approved, the
appeal is denied and T.P.M. 89-01 is approved pursuant to the
findings set forth in Section 2 below, and subject to the conditions
set forth in Section 3 below.
SECTION 2. FINDINGS.
1. The Project, its design and improvements are consistent
with the Arcadia General Plan because it provides for single family
residential development consistent with the General Plan designation
of single family residential; 0-6 dwelling units per acre.
2. The Project will not have a significant effect on the
environment because the Project is consistent with the zoning
designation, and there are no factors indicating a significant
change from the existing environment. Based on environmental review
no significant environmental impacts will result from T.P.M. 89-01.
3. The Project completes development of a single sided cul-
de-sac to a complete cul-de-sac. The lots are similar in design and
configuration to existing lots on the southside of Scott Place.
4. The lots in T.P.M. 89-01 are 30% larger than the minimum
lot size required by the Arcadia Municipal Code.

conditions of the property within the subdivision or of adjacent
property. The modifications sought by T.P.M. 89-01 relate to lot
size and configuration as specifically set forth in condition no. 4
of section 3 below. These modifications are necessary because of
the size of the area available for T.P.M. 89-01 resulting from the
size and configuration of the adjacent property i.e. the previously
developed portion of the cul-de-sac. Subject modifications are not
inconsistent with the City's General Plan, nor are they prohibited
by the Subdivision Map Act.
SECTION 3. CONDITIONS. That for the foregoing reasons the
City Council denies the appeal and upholds the decision of the
Planning Commission's approval of T.P.M. 89-01 to create three lots
from one lot at 1000 South Fourth Avenue and to realign the lot line
at 411 Scott Place subject to the following conditions:
1. The following conditions as outlined in the attached report
from the Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works:
a. The preparation and recordation of a parcel map in
accordance with the requirements of the State Subdivision Map Act.
The map shall be submitted to the County Engineer for checking, and
after checking, the County Engineers' letter recommending approval
and map shall be submitted to the City Engineer for map
certification.
b. Submit grading and drainage plan prepared by a registered
civil engineer subject to the approval of the Director of Public
Works.

c. Removal of buildings, structures and fences from the
property shall be arranged with the Director of Public Works to his
satisfaction.
d. Install six inch VCP sewer lateral to property line to
service proposed Lot 1-3.
e. Construct P.C.C. sidewalk, as per City Standard.
f. Remove and replace deficient or damaged curb, gutter or
sidewalk.
g. Construct P.C.C. driveway apron according to Arcadia
Standard Drawing No. S-ll.
h. Provide a 5' -0" wide easement to the City of Arcadia for
landscaping and sidewalk purposes along the northerly side of Scott
Place.
i. Paint house numbers on curb face per City Standards.
j. Arrange for underground utility service and dedicate
easements to utility companies.
k. Pay the following fees and deposits:

1. All public works improvements shall be completed to the
satisfaction of the Director of Public Works prior to final
acceptance by Building and Safety Department and prior to occupancy.
m. New centerline ties set as part of this subdivision must be
submitted before final acceptance of project.

n. All survey monuments, centerline ties and survey reference
points shall be protected in place or re-established where
disturbed. This work will be the responsibility of the permitee and
shall be at the permittee's expense.
2. Water service shall be provided to the satisfaction of the
Water Manager.
3. That the lot line between Lots 1 and 2 shall be moved 5'-0"
to the east.
4. That a modification shall be granted to allow the following
lot deficiencies.:
a. Lot 1 - 80'-0" width in lieu of 85'-0" required.
b. Lot 2 - 61.66' width at the front property line in lieu of
75' required.
c. Lot 2 - 71.39' width at the front setback line ln lieu of
75' required.
d. Lot 3 - 66.39' width at the front setback line in lieu of
75' required.
e. Lot 4 - 73.55' width at the front setback line in lieu of
75' required.
5. That a tree preservation plan identifying by size and type
all trees with a diameter in excess of 6" which are to be removed
and which are to be saved shall be presented to
Department for its review and approval prior to the
grading permit.

6. That building permits will not be issued for said project
until a Rough Grading Certificate certifying that all grading has
been done in substantial compliance with the final grading plan
approved by the City Engineer has been received and approved by the
ci ty Engineer.
7. That a Final Grading Certificate certifying that all finish
grading operations have been completed in substantial compliance
with the final grading plan approved by the City Engineer has been
received and approved by the City Engineer.
8. That Tentative Parcel Map 89-01 shall not take effect until
the owner and applicant have executed a form available at the
Planning Department indicating awareness and acceptance of the
conditions of approval.
SECTION 4.
The City Clerk shall certify to the adoption of
this Resolution.
