A RESOLUTION OF THE CIlY COUNCIL OF THE CITY OF
ARCADIA. CALIFORNIA, APPROVING WITH FINDINGS, AN
APPEAL OF THE PLANNING'COMMISSION'S DENIAL OF
T.M. 47234 (I.E. APPROVAL OF T.M. 47234) ,
WHEREAS. on December 19, 1988. an application was filed to Steven
Yuan to create a one sided cul-de-sac with eight (8) new single-family lots and
one trust lot at 1715-1723 South Baldwin Avenue, Planing Department Case
No. Tentative Map 47234, more particularly described as follows:
Portion of Lot 5. Block G. Santa Anita Land Company's
Tract. in the City of Arcadia. County of Los Angeles.
State of California, as per Map recorded in Book 6.
Page 137 of Maps, in the Office of the County Recorder
of said County.
WHEREAS, on February 14, and 28th. 1989 the Planning Commission
heard all public testimony and denied Tentative Map 47234 by a 3-2 vote.
WHEREAS, on March 1. 1989. the applicant appealed the Planning
Commission's denial and
WHEREAS. on April 4, 1989, the City Council heard the appeal, and
WHEREAS, as part of the record. the City Council reviewed and
considered:
a The staff report and related attachments including the "record" of
the Planning Commission's action.
b. All oral presentations, written material received and testimony
made during the public hearing on April 4, 1989.
NOW, THEREFORE, THE CIlY COUNCIL OF THE CIlY OF ARCADIA.
CALIFORNIA, DOES HEREBY DECIDE. AND RESOLVE AS FOlLOWS:
SECTION 1. DECISION. A Negative Declaration is approved. the appeal
is granted and T.M. 47234 is approved pursuant to the findings set forth in
Section 2 below, and subject to the conditions set forth in Section 3 below,
SECTION 2. FINDINGS.
1. The Project. its design and improvements are consistent with the
Arcadia General Plan because it provides for single-family residential development consistent with the General Plan designation of single-family
residential; 0-6 dwelling units per acre.

2. The Project will not have a significant effect on the environment
because the Project is consistent with the zoning designation, and there are
no factors indicating a significant change from the existing environment.
Based on environmental review no significant environmental impacts will
result from Tentative Map 47234.
3. The property subject to Tentative Map 47234 cannot be
developed in the form of a conventional cul-de-sac. The proposed map will
eliminate non-conforming and deteriorating property conditions, and will
result in a cul-de-sac street shorter than other approved cul-de-sacs and just
18 feet in excess of the general code standard, The only code defiCiency is a
shortage of 5 feet of lot depth on Lot 7 which, because of odd lot size, does
not preclude development on said lot within code requirements.
4. The discharge of sewage from the subdivision into a public sewer
will not violate requirements prescribed by the California Regional Water
Quality Control Board,
SECTION 3. CONDITIONS. That for the foregoing reasons the City
Council approves the appeal and overrules the decision of the Planning
Commission's denial of T.M. 47234 for a one sided cul-de-sac with eight (8)
new Single-family lots and one trust lot at 1715-1723 S. Baldwin Avenue
subject to the follOwing conditions:
1. The follOwing conditions as outlined in the attached report from
the Department of Public Works shall be complied with to the satisfaction of
the Director of Public Works:
a The preparation and recordation of a tract map in accordance
with the requirements of the State Subdivision Map Act. The map shall be
submitted to the County Engineer for checking, and after checking, the
County Engineer's letter recommending approval and map shall be submitted
to the City Engineer for map certification. Concurrent with the map being
submitted to the County Engineer for checking, the applicant should submit a
copy of the City's conditional requirements to enable the County Engineer to
check for applicable conditions,
b. Submit grading and drainage plan prepared by a registered civil
engineer subject to the approval of the Director of Public Works.
c. Removal of buildings, structures, and fences from the property
shall be arranged with the Director of Public Works to his satisfaction.

d. Design and construct 550 feet of sewer extension in proposed
new street.
e. Install six inch VCP sewer lateral to property line to service
proposed lots.
f. Plant parkway trees at locations determined by the Director of
Public Works per City of Arcadia Standard S-13,
g. Close existing driveways not to be used and reconstruct curb,
gutter and sidewalk to match existing,
h. Construct P.C.C. sidewalk, as per City Standard.
1. Remove and replace deficient or damaged curb, gutter or
sidewalk.
J. Construct' P,C.C. driveway apron according to Arcadia Standard
Drawing No, S-I1.
1. Construct P.C.C. ramp for the handicapped per City of Arcadia
Standard Drawing No. S-22.
k. AI' Control strip along the southerly property line shall be
dedicated to the City of Arcadia in addition to a 5' wide easement for
landscaping and sidewalk purposes (along Baldwin Avenue and new street).
I. Paint house numbers on curb face per City standards.
o m. Submit water, sewer and street improvement plans per City
standards.
n. Arrange for underground utility service and dedicate easements to
utility companies.
0, Arrange with Edison Company to install street lights with
underground circuits, Location and number of lights subject to approval of
the Director of Public Works.
p. Pay the following fees and deposits:
Stop Sign $ 100,00
Street Sign $ 125,00
Street Tress (24 @ $40) $" 960.00
Final Approval (8 @ $25) $ 200,00
Map Fee $ 25,00
$ 1,410.00
q. All public works improvements shall be completed to the
satisfaction of Director of Public Works prior to final acceptance by Building
and Safety Department and prior to occupancy.

r, New centerline ties set as part of this subdivision must be
submitted before final acceptance of project.
s, All survey monuments, centerline ties and survey reference points
shall be protected in place or re-established where disturbed. This work will
be the responsibility of the permittee and shall be at the permittee's expense.
2. Fire safety shall be provided to the satisfaction of the Fire Chief. A
hydrant will be required approximately 300' west of Baldwin Avenue with a
minimum fire flow of 1500 g.p.m.
3. That the maximum finished grade of each new lot (not including
pad area) shall not exceed 1.5' above the finished grade of any existing
adjoining lot.
4. That a tree preservation plan identifying by size and type all trees
with a diameter in excess of 6" shall be presented to the Planning
Department for its review and approval prior to the issuance of a I!radinl!
permit.
5. That building permits will not be issued for said project until a
Rough Grading Certificate certifying that all grading has been, done in
substantial compliance with the final grading plan approved by the City
Engineer has been received and approved by the City Engineer.
6. That a Final Grading Certificate certifying that all finish grade
operations have been completed in substantial compliance with the final
grading plan approved by the City Engineer has been received and approved
by the City Engineer.
7. That the street name shall be "Sharon Road".
8. Prior to approval of the Final Map, the illegal sale of the 4'-0" wide
strip along the west property line will have to be resolved and ownership of
the property reverted back to the property on Baldwin Avenue. Proof shall be
provided to the City to confirm that this has been done.
9. That the proposed 6'-0" will to be located along the north and
south property lines of the proposed subdivision shall be constructed of
decorative block. The material for said wall shall be submitted to the
Planning Department for review and approval prior to construction of the
wall.
10. That Tentative Map 47234 shall not take effect until the owner
and applicant have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.

SECTION 4.
The City Clerk shall certify to the adoption of this
Resolution.
