HomeMy WebLinkAbout4312 RESOLUTION NO. 4312 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO.. 6. BE IT RESOLVED by the City Council of the City of Arcadia as follows: WHEREAS, by Resolution No. 4304, a public hearing was called for 19 December 1972 at the hour of 7:30 o'clock p.m., in the Council Chambers in the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead struc- tures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, wi thin that certa'in area of the City described as follows: Beginning at the intersection of the center line of Santa Anita ,Avenue and a line that is parallel with the center line of Campus Drive and distant northerly 40 feet therefrom; thence westerly along said parallel line to its intersection with the center line of Arcedia Wash; thence northwesterly along last mentioned center line and following same through its various courses and distances to its in~ersection with a line that is parallel with the center line' of Huntington Drive (east bound) and distant northwesterly 35 feet therefrom; thence southwesterly along last mentioned parallel 'line to its intersection with the west- erly line of Holly Avenue; thence southerly along said westerly line to its intersection with a line that is parallel with the center iine of Campus Drive ,and distant southerly 75 feet there- from; thence along last mentioned parallel line and following same'through its various courses and distances to its intersection with the center line of above mentioned Santa Anita Avenue; thence northerly along last said center line to the point of beginning. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized -1- 4312 assessment roll and to all.utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arcadia, that pursuant, to Ordinance No. 1375 of the City of Arcadia, the above d~scribed area is hereby declared an underground utility district and is designated .as Underground Utility District No.6 of the City of Arcadia. RESOLVED, FURTHER, that the City Council does hereby fix 1 August 1973 as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, over.head wires and associated overhead struc- tures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No.6 on or before 31 August 1973. RESOLVED, FURTHER, that the City Council of the City of Arcadia hereby finds and determines that the publiC necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in said area. RESOLVED, FURTHER, that the following exception in said Underground Utility District No.6 is hereby authorized: The overhead street lighting system along Huntington Drive need not be removed. -2- 4312 RESOLVED, FURTHER, that said City Council finds and determines: 1. That the undergrounding to be accomplished pursuant , to this resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. 2. The streets, roads or rights-of-way in said area ~re extensively used by the general public and carry a heavy volume of pedes trian and vehicular traffic.. 3. The rights-of-way adjoin or pass through the Los Angeles County - Arcadia Park, a public recreation area, and the Los Angeles County - Arcadia Park Rose Garden which is an area of unusual scenic interest to the general public. RESOLVED, FURTHER, that the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. The City Clerk shall certify to the adoption of this resolution.
