HomeMy WebLinkAbout5263 RESOLUTION NO. 5263 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING IT TO BE OF URGENT NECESSITY FOR THE PRESER- VATION OF PROPERTY THAT A LANDSCAPE MAINTENANCE CONTRACTOR BE SELECTED THROUGH REQUEST FOR PROPOSALS (FOUR VOTES REQUIRED) WHEREAS, Section 1212 of the Arcadia City Charter authorizes letting of contracts without advertising for bid pursuant to the determination of an urgent necessity for the preservation of property and a declaration of facts supporting the urgency; and WHEREAS, the City of Arcadia contracts for the care and maintenance of City landscaping; and WHEREAS, the care and maintenance of City landscaping entails the preservation of City property and the care of living organisms such as plants, trees, grass; and WHEREAS, until the retention of the current contractor, the previous two contractors caused substantial problems to the condition of the landscape maintenance areas and without prompt action by the City, substantial damage and loss to City property would have occurred. In fact, large areas of lost and damaged lawn, landscaping and shrubbery resulted from performance by low bid contractors, and WHEREAS, the landscaped maintenance areas of the City of Arcadia are an integral part of the community promoting the health, safety and welfare of the City; and -1- 5263 WHEREAS, recent experience has demonstrated that inadequate maintenance causes destruction and damage of landscaped areas; and WHEREAS, to retain an experienced and responsive landscape maintenance contractor it is desirable to utilize the request for proposal procedure providing for ultimate selection based on numerous crucial factors including price; and WHEREAS, the performance of landscape maintenance contracts involves continuous on-going professional services which include responsiveness to a multitude of unique circumstances. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council determines that there is an urgent necessity for the preservation of property and therefore authorizes the letting of a contract for landscape maintenance without advertising for bids and subject to a selection process based on request for proposals as determined by the Public Works Director of the City of Arcadia. The request for proposal shall include contract price as an important criteria of selection, however, lowest price shall not necessarily bind the City to that bidder in view of the urgency and related circumstances as set forth in this Resolution and related reports. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution. -2- 5263 Passed, approved and adopted this 17th day of December, 1985.
