HomeMy WebLinkAbout5264 RESOLUTION NO. 526~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AUTHORIZING THE INITIATION OF EMINENT DOMAIN PROCEEDINGS IN CONNECTION WITH THE ACQUISITION OF CERTAIN PROPERTY (GOLDRING TRUST PROPERTY) WHEREAS, the City Council of the City of Arcadia, California, has prepared plans for the acquisition of certain real property and construction thereon of facilities for purposes of a City Yard; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION l. That the City Council hereby accepts the report of the City Staff as submitted to the City Council on December l7, 1985, in which the City Staff summarized the efforts of the City to acquire certain property for purposes of a City Yard by negotiated offer. SECTION 2. That the City Council hereby authorizes the initiation of eminent domain proceedings pursuant to Code of Civil Procedures Section l245.220 in order to acquire fee title in certain real property as more fully described in Exhibit "A" as attached hereto and incorporated herein by this reference. For purposes of convenience and reference, said real property has been identified in Exhibit "A" as the "Goldring Trust Property". SECTION 3. That the City Council hereby sets a Hearing on the proposed acquisition of the Goldring Trust Property, by an exercise of the power of eminent domain for January 7, 1986 at 7:30 p.m. in City Council Chambers, City of Arcadia City Hall. -1- 5264 The City Staff is hereby authorized and directed to mail notice of such hearing to the owner(s) of the Goldring Trust Property, or in the event that the City Staff determines that the address of the owner(s) of said parcels of real property cannot reasonably be ascert~ined from the official records of the Office of the Assessor of the County of Los Angeles, a Title Report, or otherwise, the City Staff shall cause to be published a notice of said hearing substantially in the form as required by Code of Civil Procedure Section l245.235. SECTION 4. That the City Staff is further directed to prepare and to transmit a written offer for the acquisition of the real property as described in Exhibit "A" to the owner(s) thereof in accordance with Code of Civil Procedure Section 1245.230(c)(4). The amount of said offer shall be based upon the appraisal of value of such real property as has previously been provided to the City by a real property appraiser. Said offer shall be conditioned upon either ratification by the City Council of the City of Arcadia of said offer by the execution of a contract of acquisition or by the adoption of a resolution of necessity by the City or both. SECTION 5. That the City Staff shall prepare the appropriate evaluation of the environmental effects of the proposed acquisition of the property pursuant to California Environmental Quality Act of 1970 as amended and submit said evaluation to the City Council for its review and consideration on January 7, 1986. The City Staff shall prepare such other reports and estimates of costs as may be appropriate in 2 5264 connection with the acquisition of said property. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution. Passed, approved, and adopted this 17th day of December, 1985. t;2 .
