HomeMy WebLinkAbout5281 RESOLUTION NO. 5281 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE DECISION OF THE PLANNING COMMISSION GRANTING CONDITIONAL USE PERMIT 85-23, WITH FINDINGS WHEREAS, on December 23, 1985. an application was filed by Public Storage, Inc, to construct and operate a public storage facility with a security managers unit, Planning Department Case No, CUP 85-23, on property located on the south side of Lower Azusa Road, east of Roseglen, more particularly described on attached Exhibit A; and WHEREAS, a public hearing was held before the Planning Commission on January 14, 1986; and WHEREAS, after a public hearing the Planning Commission voted 7-0 to approve Conditional Use Permit 85-23 and adopted Planning Commission Resolution l306 reflecting their decision; and WHEREAS, on February 18, 1986 the City Council heard the appeal from the Planning Commissions action filed by the City of EI Monte concerning Conditional Use Permit 85-23; and WHEREAS, as part of the record of this hearing the City Council reviewed and considered: a, All staff reports and related attachments and exhibits submitted by the Planning Department to the Planning Commission and City Council. -1- 5281 b. The record of the Planning Commission hearing regarding CUP 85-23, c, Written communications submitted by Appellant, d. Studies and staff reports submitted as part of the City Council agenda package including the contents of Planning Commission Resolution No, l306, e. All oral presentations and testimony made during the public hearing on February l8, 1986, WHEREAS, after deliberation the City Council voted 5-0 to approve and file a Negative Declaration finding that the project will not have a significant affect on the environment and no substantial adverse impact, and to deny the appeal and sustain the approval of the Planning Commission and directed preparation of this Resolution to formally reflect that decision and findings. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1, The City Council finds: I. That the granting of CUP 85-23 will not be detrimental to the public health or welfare, or injurious to property or improvements in the zone or vicinity because the proposed use is a low traffic generator and is a less intense use than the typical industrial development for which the property is zoned, Subject property is zoned M-2 which allows a number of heavy manufacturing uses as set forth in the zoning code of the City of Arcadia, The operation of a public storage facility as proposed involves minimal traffic impact and customer usage, and will have -2- 5281 security and hourly controls. Further, based on sewage studies and other related evidence concerning this project, ground water quality will not be affected by installation of the on site disposal system. For these reasons and those set forth below CUP 85-23 is consistent with the public convenience and welfare and can be harmoniously adjusted to the surrounding uses and the community. 2. That the use applied for at the location indicated is properly one for which a conditional use permit is authorized because subject zone allows for the proposed use subject to a conditional use permit, 3. That the site for the proposed use is adequate in size and shape to accommodate said use and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood because of the following reasons: a. Those set forth in *1 and *2 above, b. Traffic study surveys conducted regarding the operation of similar self service facilities disclosed that these uses do not need the amount of parking that other permitted uses in the industrial zone require. Typically, businesses in an industrial zone are engaged in processing, assembling, manufacturing and warehousing of products which require parking for employees, The parking needs for a self-storage facility are limited to persons paying their monthly bills and persons making inquiries, All loading and unloading of material is done at the storage unit, -3- 5281 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use for the reasons set forth in #3 above and because Lower Azusa Road is designated as a major arterial on the General Plan and is adequate in width and pavement type to carry the limited amount of traffic generated by this use, 5, That the granting of this Conditional Use Permit will not adversely affect the comprehensive General Plan since the General Plan designation for this site is industrial. 6, That conditions as set forth below have been applied to assure the proposed use is desirable and essential to the public convenience and welfare and can be harmoniously adjusted to the surrounding uses and the community. SECTION 2. That for the foregoing reasons this Council grants Conditional Use Permit 85-23 to construct and operate a public storage facility with a security manager's unit subject to compliance with the following conditions: l, That the use may be serviced by a septic tank which shall be designed and installed to the satisfaction of the director of public Works, 2, That Fire safety shall be provided to the satisfaction of the Fire Chief, 3. Water service shall be provided to the satisfaction of the San Gabriel Valley Water Company, 4, That this Conditional Use Permit shall not take effect until Tentative Parcel Map 85-16 (Parcel Map No. 17535) is recorded in the County Recorder's office. -4- 5281 5, That a restrictive covenant, or other appropriate agreements as deemed necessary by the City Attorney, be provided to insure that the proposed buildings shall remain self-storage as per the plans on file and that it shall not be subdivided for individual industrial users or used an an industrial warehouse or have any office or retail square footage unless parking is provided as required by the Arcadia Municipal Code, 6. That two covered parking spaces shall be provided for the security manager's unit, 7. That outdoor storage of any kind shall be prohibited unless a conditional use permit is granted. 8, That the security manager's unit shall be occupied only by the manager who is employed to manage the self-storage facility and his/her family, 9. That the security manager's unit and self-storage facility shall be maintained as per the plans on file in the Planning Department, 10. That a modification shall be granted for II parking spaces in lieu of 126 parking spaces required, II. That a maximum 6'-0" high wall shall be located along the perimeter of the property in lieu of a 6'-8" high wall with barbed wire on top as requested by the applicants, 12, That the landscaped areas adjacent to the buildings shall be bermed, 13, That a landscape and irrigation plan shall be submitted to the Planning Department for its review and approval prior to issuance of any building permits, -5- 5281 14, That the buildings shall be earth tone in color and said final color scheme shall be approved by the Planning Department. IS. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works, Provide calculations for both the gravity drainage system and the pump drainage system, computations should show hydrology, hydraulics, elevations and all the details requested on the City's "Pump Drainage" sheet. 16, Plant parkway trees at locations determined by the Director of Public Works, l7, Construct P,C,C, sidewalk as per City of Arcadia Standard Drawing S-l7, 18. Gravity drainage outlets and driveway aprons shall be constructed to conform to Drawing S-ll. 19, That CUP 85-23 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval, 20, Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit, -6- 5281 SECTION 3.
