HomeMy WebLinkAbout5283 RESOLUTION NO. 5283 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 11 WHEREAS, the City Council of the City of Arcadia, at its regular meeting of March 4, 1986, called for a public hearing on March 18, 1986, at the hour of 7:30 o'clock p.m., in the Council Chambers at the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City described as follows: That portion of a Part of Arcadia Santa Anita Tract as shown on map recorded in Book 15, Pages 89 and 90 of Miscellaneous Records in the office of the Recorder of Los Angeles County, bounded as follows: On the north by the center line of Huntington Drive; on the east by the westerly 1 ine of Second Avenue; on the south by the south right-of-way line of the first alley south of Huntington Drive; and on the west by the east right-of-way line of Santa Anita Avenue. WHEREAS, not ice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That pursuant to Ordinance No. 1375 of the City of Arcadia, the above-described area is hereby declared an underground utility district and is designated as Underground Utility District No. 11 of the City of Arcadia. -1- 5283 SECTION 2. That the City Council does hereby fix January 1, 1987 as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, conununication, or similar or associated service with Underground Util ity District No. 11 on or before February 1, 1987. SECTION 3. That the City Council of the City of Arcadia hereby finds and determines that the Public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in said area. SECTION 4. That said City Council finds and determines: 1. That the undergrounding to be accomplished pursuant to this resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. 2. The streets, road or right-of-ways in said area are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. SECTION 5. That the City Council finds and determines that the Southern California Edison Company will charge against the City of Arcadia's Rule 20A allocations all costs of converting to underground each customer's service lateral, up to 100 feet from the distribution line. The City will be responsible, physically and financially, for converting and relocating, as necessary, the overhead service entrance to accept the underground service lateral. -2- 5283 SECTION 6. That the City Clerk, within ten (lO) days after the adoption of this resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 7. That the City Clerk shall certify to the adoption of this Resolution.
