HomeMy WebLinkAbout5300 RESOLUTION NO. 5300 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 86-2 TO RECONSTRUCT THE GARAGE PORTION OF AN EXISTING AUTOMOBILE SERVICE STATION AND CONSTRUCT A 3,600 SQUARE FOOT RETAIL BUILDING AT 529 EAST LIVE OAK AVENUE. WHEREAS, on January 28, 1986 an application was filed by Narcis Aroyan DBA Hi Mart Service Station to reconstruct the garage portion of an existing automobile service station and construct a 4,000 square foot retail building (plan was revised to 3,600 square feet) at' 529 East Live Oak Avenue, Planning Department Case No. C.U.P. 86-2, on property commonly known as 529 East Live Oak Avenue, more particularly decribed as follows: Lot 6 and part of Lot 109, Arcadia Acreage Tract, in in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 10, Page 18 of Maps, in the Office of said County Recorder. WHEREAS, public hearings were held on February 25, 1986 and March 11, 1986, before the Planning Commission and; WHEREAS, after the March 11, 1986 public hearing the Planning Commission voted 5 to 2 to deny Conditional Use Permit 86-2 and adopted Planning Commission Resolution 1309 reflecting their decision; and WHEREAS, on May 6, 1986 the City Council heard the appeal of the Planning Commission's action filed by Narcis Aroyan concerning Conditional Use Permit 86-2; and WHEREAS, as part of the record of this hearing the City Council reviewed and considered: a. All staff reports and related attachments and exhibits submitted by the Planning Department to the Planning Commission and City Council. b. The record of the Planning Commission hearing regarding C.U.P. 86-2. c. Written communications submitted by Appellant. d. All oral presentations and testimony made during the public hearing on May 6, 1986. -1- 5300 WHEREAS, after deliberation the City Council voted 5-0 to approve and file a Negative Declaration finding that the project will not have a significant effect on the environment or any substantial adverse impacts, and to approve the appeal reversing the denial of the Planning Commission and directed preparation of this resolution to formally reflect that decision and findings. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. SECTION 2. That for the foregoing reasons this Council grants Conditional Use Permit 86-2 to reconstruct the garage portion of an existing automobile service station and construct a 3,600 square foot retail building subject to compliance with the following conditions: 1. The memorandum dated February 11, 1986 from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. Fire protection shall be provided as required by the Fire Department. A building fire alarm system wil be required. 3. New water service shall be installed by the Arcadia Water Department at the 'developer's expense. Page 2 5300 4. The canopy over the gasoline pumps shall be remodeled to be architecturally consistent with the other buildings on the site. This shall be subject to the review and approval of the Planning Department. 5. All the employees vehicles for the site and vehicles to be serviced by the automobile service station shall be parked on the premi ses. 6. A covenant shall be recorded which will hold the lots as one parcel. This shall be completed to the satisfaction of the Planning Department and City Attorney before the issuance of building permits. 7. The sale of alcoholic beverages shall be prohibited for any business located on the subject site. 8. All work for the automobile service station shall be done inside the buil di ng. 9. The site shall be maintained as per the plans on file in the Planning Department. 10. The automobile service station shall adhere to Code Section 9275.4.7 which describes the activities permitted and prohibited, except that shall not be allowed on the site. All deliveries shall be between the hours of 7:00 a.m. and 10:00 towing servi ce 11. p.m. 12. pa rked on the 13. 14. No vehicles which are offered for sale, lease or rent shall be premises. Lighting shall comply with Code Section 9263.6.1. That the service station attendant shall be limited to handling only transactions for the service station (including the garage). 15. The following modifications shall be granted: A. 5'-3" setback from Sixth Avenue in lieu of 35'-0" for proposed automobile B. of 20% (9269.5.1). 16. That the handicap bathrooms shall remain open during the business hours of both the retail building and the automobile service station. The mansard roof for the service station shall be extended to include the north elevation. This shall be subject to the review and approval of the Planning Department. 18. Work within the garage of the automobile service station shall be limited to the hours of 8:00 a.m. to 8:00 p.m. 19. That C.U.P. 86-2 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 20. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocat i on of sa i d Pe rmi t. SECTION 3: The City Clerk shall certify to the adoption of this Resolution.
