HomeMy WebLinkAbout5664 RESOLUTION NO. 5664 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A PERMIT FOR THE INSTALLATION OF GAME AMUSEMENT MACHINES AT STAR LIQUOR (8 WEST DUARTE ROAD) WHEREAS, Star Liquor through its owner (Chi Chae Lee) appealed the denial by the Arcadia Business License and permit Review Board of a permit to install game amusement machines; and WHEREAS, a noticed appeal hearing was scheduled before the city Council on May 5, 1992; and WHEREAS,. the City Council considered the "record" of the hearing including staff reports, certain communications submitted by those in favor and opposed to the denial of the game permit and oral evidence; and WHEREAS, at the conclusion of the public hearing, the City Council reviewed this issue and made its determination, directing staff to prepare the appropriate resolution reflecting that decision. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The game amusement machine permit for Star Liquor is denied and the decision of the Business License and Permit Review Board is therefore sustained, based on the findings set forth below: SECTION 2. FINDINGS. a. Star Liquor allowed game machines without a permit. b. Game machine regulations as attached to this Resolution set forth in Arcadia Municipal Code section 6411.5 were repeatedly violated. 5664 c. The above violations included allowance of juveniles on the property inconsistent with game machines regulations. d. Those responsible for star Liquor have continuously failed to control the situation and to assure compliance with the game machine regulations. e. Various conditions occurring at the store attributable to the presence of game machines and the lack of supervision and control created nuisance type conditions on and about the premises. f. The aforementioned and related conditions on or about star Liquor as a result of the game machines are injurious, detrimental and harmful to the public peace, health, safety, and welfare of the city and its inhabitants. Further, the allowance of activities that have become a public nuisance exist on the premises as a result of the attendance of various patrons attributable to the game machines. This is contrary to the free enjoyment of life and property in the City of Arcadia, and does not comport with the peace, health, safety and convenience of the public. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution. Passed, approved and adopted this 19th day of , 1992.
